g, plication for the permit must include construction drawings showing proposed method installation, structural engineering analysis, and a site plan depicting structures and tings on the property and all adjacent properties. At the request of the administrative thority, documentation of a maintenance program may be required. h. any modifications are made to the structure, the City shall have the authority to require proof that the addition, change, or modification is in conformity with the permit and the 13 form Building Code. i. e owner of such a structure shall assume complete liability in case of personal or operty damage. 5. The Planning Commission and Council find all criteria of Section 4-600 (2) to be met. 6. Zo g Code Section 4-600 (4) establishes the following Special Use Permit standards for tele mmunications equipment: a. e application for special use permit shall be processed according to Chapter 8 of the Wing Code. b. pplications for special use permits must meet the standards of Section 4-600 (2), A-1. c. ireless telecommunication towers/antenna may be constructed to a height that exceeds e required setback up to 33%. As a condition of approval, the City must be provided kith a licensed professional engineer's certification that the tower is designed to collapse fail within a distance or zone shorter than the required setback distance as determined the height of the structure or telecommunication tower. The required setback is ecified in Section 4-600 (2), A-B. 7. The. lanning Commission and City Council find all criteria of Section 4-600 (4) to be met. 8. The lanning Commission and City Council reviewed the proposal in accordance with the foll ing Special Use Permit conditions of Section 8-130: a. That the establishment, maintenance, or operations of the special use will not be etrimental to or endanger the public health, safety, morals, comfort or general welfare. b. That the special use will not be injurious to the use and enjoyment of other property in e immediate vicinity for the purposes already permitted, nor substantially diminish and pair property values within the neighborhood. c. That the establishment of the special use will not impede the normal and orderly evelopment and improvement of the surrounding property for uses permitted in the istrict. d. hat adequate utilities, access roads, drainage and/or necessary facilities have been or are eing provided. e. at the special use shall in all other respects conform to the applicable regulations of the istrict in which it is located. 9.
