<br /> <br /> <br /> <br /> RESOLUTION NO. 07-071 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAmsEY <br /> CITY OF NEW BRIGHTON <br /> i <br /> RESOLD TON MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT, PLANNED <br /> UNIT ,VELOPMENT, AND SITE PLAN. <br /> WHEREAS, an application has been made Pratt Ordway Properties to be considered for an <br /> amen ent to a previously approved Planned Unit Development allowing for development to <br /> the last vacant site at Main Street Village, known as Parcel B of Lot 4, Block 1, MAIN STREET <br /> VILLAGE FIRST ADDITION. <br /> WHEREAS, the procedural history of the application is as follows: <br /> 1. T City Council approved a Planned Unit Development for Phase 1 and Phase 2 of Main <br /> St et Village in May and June of 2000. <br /> 2. The City Council approved a General Development Plan for Main Street Village in June of <br /> 2001 and an amendment to that plan in September of 2002. <br /> 3. A lications for a Special Use Permit, Planned Unit Development, and Site Plan were <br /> re ived on June 1, 2007 to permit development of the remaining vacant site within Main <br /> St et Village. <br /> 4. T Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> on une 19, 2007 and all present were given a chance to freely speak at the hearing. <br /> 5. T City Council considered the request on June 25, 2007. <br /> WHERE S, the Planning Commission and City Council make the following Findings of Fact with <br /> respec to SP2007-006, PUD2007-006, and LP2007-007: <br /> 1. T site is zoned B-4, Downtown Business and guided in the New Brighton Comprehensive <br /> Ph for Neighborhood Business. <br /> 2. T site is legally described as follows: <br /> T North 155.40' feet of Lot 4, Block 1, Mainstreet Village First Addition, Common <br /> Interest Community Number 416, Ramsey County, Minnesota. <br /> 3. T site is part of a previously approved Planned Unit Development and General <br /> Development Plan. <br /> 4. T proposal to construct a 6,858 s.f. multi-tenant retail building is consistent with the <br /> previously approved Planned Unit Development and General Development Plan. <br /> 5. T Planning Commission and City Council considered the proposal against the following <br /> co itions of Zoning Code Section 8-130, related to a Special Use Permit: <br /> a. That the establishment, maintenance, or operations of the special use will not be <br /> detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br /> b. That the special use will not be injurious to the use and enjoyment of other property in <br /> he immediate vicinity for the purposes already permitted, nor substantially diminish and <br /> 'mpair property values within the neighborhood. <br /> c. That the establishment of the special use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> istrict, <br /> d.
