Nimmer replied that the <br />City is proposing to place a blanket over the landfill to capture the gas with pipes corning out to vent the gas, <br />but it will not be cooked off. <br />Schiferl questioned if there will be summary overview for the entire packet. Nimmer replied that there is an <br />executive summary in the front of the packet, <br />Public Hearings: SP2007-005, LP2007-008 General Development Plan Amendment TimberCraft Enterprises, <br />Inc. <br />The applicant has requested an amendment to their previously approved site plan for the former Marv's <br />Transmission site at 715 Old Highway 8 NW, The proposed amendment would allow for construction of a <br />2,778 s,f. second story to be used exclusively for storage purposes. <br />In August of 2006 the applicants obtained Site Plan & General Development Plan approval establishing how the <br />property would be developed. Since that time, the applicants have been working towards locating tenants for <br />the building. However, the Site Plan approval technically expired on February 22, 2007 in accordance with <br />Zoning Code Section 8-040 (1). Therefore, a new Site Plan must be approved that will give the applicant an <br />additional 180 days to apply for a building permit, <br />BaTberCraft, n inquired why a bathroom is included on the second floor if it is for storage only. John Stenglein, <br />stated that it is included for a work out area. He added that the company is a financial planning <br />organization and the FCC requires that they provided storage of all of their records on site for seven years. <br />Baker asked why they have not considered a basement. Stenglein replied that a basement is very expensive and <br />to build a basement it would be required to encroach on the right-of-way of Old Highway 8. <br />Scott Vaughn, 736 4th Ave NW, stated that he is concerned with parking. He stated that he has no problem with <br />the second floor for storage as long as there is a covenant to prevent the storage space changing use. <br />Motion by Schiferl, Second by O'Keefe to CLOSE THE PUBLIC HEARING. <br />6 Ayes, 0 Nays. MOTION CARRIED. <br />Baker stated that he is conflicted about approving the building and is worried that several years from now <br />someone will approach the City about using the space for something other than storage. Zisla stated that the <br />restriction of the covenant should be part of the approval. Gundlach replied that the covenant will be recorded <br />against the title. She added the Building Department's permitting system could trigger a flag if someone comes <br />in for building permit relating to the second floor, in addition the neighbors making concerns known to the City <br />is parking does become a problem. The covenant will allow the City to dismantle any office if it should appear <br />without the City's knowledge. <br />Mann inquired if the space up stairs would be finished, then a building permit would not be required. Stenglein <br />plied that the space will be sheet rocked only, and would not be considered finished. Baker stated that he is <br />16encerned about parking, which was originally approved for one stall per 200 square feet, which included <br />storage. Gundlach replied that the one per 200 is based on the average office user. Zisla asked if they increased <br />the amount of office space.
