Ig - <br /> I` <br /> S <br /> ~I <br /> f <br /> I <br /> i <br /> I RESOLUTION No.07-081 <br /> { STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> 4• <br /> CITY OF NEw BRIGHTON <br /> i <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF AN AMENDMENT TO SITE PLAN <br /> LP200~-001, DOCUMENTED UNDER RESOLUTION # 07-042. <br /> i! <br /> WHERE an application has been made by Norm Wells on behalf of Manfred Niedernhoefer to <br /> be considered for an amendment to a previously approved Site Plan, which reduces the amount <br /> of buil ing addition by half and increases the amount of required parking stalls. <br /> ,i <br /> WHERE , the procedural history of the application is as follows: <br /> 1. T City Council approved LP2007-001 on May 8, 2007. <br /> 2. application for a Site Plan Amendment was received on June 29, 2007. <br /> 3. T Planning Commission considered the amended Site Plan on July 17, 2007. <br /> 4. T City Council considered the request on July 24, 2007. <br /> WHERE' s, the Planning Commission and City Council make the following Findings of Fact with <br /> respect to amended LP2007-001: <br /> 1. T Site Plan was previously approved in Resolution #07-042 and outlines development of <br /> the site in compliance with the 1-1 standards noted in Section 6-060. <br /> 2. T proposed amendment to decrease the proposed addition to 7,380 s.f. from 14,124 s.f. <br /> d s not negatively impact compliance with Zoning Code Section 6-060. <br /> 3. TO amended Site Plan no longer requires a Variance and as such the Variance previously <br /> ap roved in Resolution 07-042 (VN2007-001) becomes null and void. <br /> 4. ile the amount of building square footage decreases, the amount of proposed office space <br /> in eases, requiring an increase in the total amount of parking stalls to be provided. <br /> 5. In uding the proof-of-parking stalls, adequate parking is provided based on the amended <br /> floor plan of the proposed addition. <br /> 6. loading dock has been relocated further south on the property, remaining at least 40' <br /> fr~ the front lot line, complying with Chapter 11 of the Zoning Code. <br /> 7. Tamended Site Plan does not change the approvals for the Nonconforming Use Permit <br /> or Preliminary and Final Plat (PL2007-001, FP2007-001) documented under i <br /> R olution #07-042. <br /> 8. T amended Site Plan will still comply with the conditions noted in Resolution #07-042. <br /> 9. T amended Site Plan is contingent on the Mounds Avenue Vacation approved in <br /> R olution 407-043. <br /> I; <br /> Now EREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Sit Ian Amendment (LP2007-001) is hereby approved, subject to continued compliance with <br /> Reso tion #07-042, which states the following conditions: <br /> 11 Development of the site in accordance with attached Exhibit A. <br /> 2, Approval of the partial vacation of Mounds Avenue, that portion of which is located at <br /> the northeastern corner of the City.
