Page 5 — July 24, 2007 New Brighton Council Minutes City Planner Janice Gundlach explained this would establish a new Zoning istrict, to codify items included in the Northwest Quadrant framework lan. Ms. Gundlach explained all properties in the NWQ are currently oned MX- (mixed use.) In the NWQ code, development parameters are included. The Planning commission recommends approval of the ordinance. Staff suggested as development continues, it may be necessary to amend the code. Councilmember Doffing suggested deleting the section 3E; pertaining to libraries; because council had previously determined a library would not be suitable in the Northwest Quadrant. Motion by Council Member Hoffman, seconded by Council Member Doffing to adopt the attached ordinance establishing the Northwest Quadrant zoning district as amended by Councilmember Doffing and Mayor Larson, deleting item 3E under Office Uses. 4 Ayes - 0 Nays, Motion Carried 6. Consideration of proposed settlement agreement with Ferrellgas, Inc. for acquisition of property at 1430 Old Highway 8 NW. Report No. 07 -199 Assistant Director of Community Development David Black offered a brief background related to the acquisition. A proposed settlement offer was presented to the City. The proposed settlement amount was $1,144,123.90. Staff considers this a fair proposal; the City obtains flexibility in acquiring the site. Mayor Larson stated that significant discussion was had at the preceding work session. Motion by Council Member Hoffman, seconded by Council Member Bauman to Approve a settlement amount of $1,144,123.90 with Ferrellgas, Inc. for the payment of all claims related to the acquisition of the property at 1430 Old Highway 8 NW and relocation of the occupant, and authorize the Mayor and City Manager to execute the necessary agreements. 4 Ayes - 0 Nays, Motion Carried 7.
