1irWBRO1C_jHT0N
the city that works !or you
Report Number: 9-
Agenda Section:
Report Date 8/24/2007
Council Meeting Date 8/28/2007
0 REQUEST FOR COUNCIL CONSIDERATION
ITEM DESCRIPTION: Approval of an ordinance summary to be published in the September 5, 2007
edition of the Bulletin regarding the NWQ Rezoning Ordinance.
DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director
CITY MANAGER'S APPROVAL:
No comments to supplement this report-7_,//1 Comments attached
Recommendation: Motion to approve t t5l_,?ummary as written below dete rmining that it clearly
informs the public of the effect and impact of the NWQ Rezoning Ordinance. This summary would be
published in the September 5`h edition of the Bulletin.
Legislative History: August 28, 2007: The City Council adopted an Ordinance Rezoning all property
within the Northwest Quadrant from R-3A, Multi-Family Residential and MX, Mixed Use to NWQ,
Northwest Quadrant District.
Financial Impact: None
Explanation: The Council is being asked to adopt an Ordinance rezoning all property within the
is Northwest Quadrant from R-3A, Multi-Family Residential and MX, Mixed Use to NWQ Northwest
Quadrant District on August 28, 2007. Procedurally, the actual ordinance doesn't become effective until
it is published. Minnesota State Statute 412.191, subdivision 4 allows the City Council to approve a
summary to be published in place of the actual ordinance. Because the actual ordinance is 13 pages
consisting almost entirely of legal descriptions, staff would recommend that a summary be published in
place of the entire ordinance to save on publishing costs. In addition to publishing a summary, staff will
also publish the map attached to the rezoning ordinance clearly identifying which properties are being
rezoned. Staff` would recommend that the Council approve the following summary:
"The City Council of the City of New Brighton adopted the NWQ Rezoning Ordinance on August
28, 2007. This ordinance rezones the property identified on the map below from R-3A, Multi-Family
Residential and MX, Mixed Use to NWQ, Northwest Quadrant District. A complete copy of the NWQ
Rezoning Ordinance, including the legal descriptions of all property rezoned, can be viewed at City 1Iall
located at 803 Old Highway 8 NW, New Brighton, MN, 55112."
Costs and Funding: Not Applicable
- 4W?
Janice Gundlach
City Planner
0
