Council Proceedings <br />City of New Brighton <br />October 26, 1978 <br />stated that they very much appreciate the language in the <br />Comprehensive plan regarding their property. Mr. Otte <br />questioned however what assurance this wording provided were <br />U.O.P. to expand. Mr. Otte stated they would like some legal <br />assurance of this passage so that U.O.P. could expand without <br />having future problems. <br />Motion by Senden, seconded by Janecek to have the legal staff <br />review and comment regarding the proposed classification of <br />Light Industrial for the U.O.P. Johnson property and its effect <br />regarding possible building expansion. <br />5 ayes - 0 nayes - carried <br />Mr. Thomas Walker, Box 96, Brook Park, stated that he owned <br />property just north of Minnesota Federal on the west side of <br />Silver Lake Road. Mr. Walker stated that several people have <br />contacted him about using the property for a real estate office <br />but that the City has not permitted this use. Mr. Walker also <br />stated that he was opposed to the median on Silver Lake Road <br />and to the fact that the grade of Silver Lake Road had been <br />lowered causing problems in getting into his property. Mr. <br />Walker also reviewed circumstances regarding a proposed rezoning <br />several years ago that was turned down as a result of a referendum <br />vote. Mr. Walker stated that he filed a plat with Ramsey County <br />that was of record and that the plat can not be changed. <br />Mr. Walker lastly indicated that he thought a real estate business <br />would be good for the property. <br />Mr. John Daubney, attorney, was present representing Willmus <br />Property, Inc. Mr. Daubney stated that his clients were opposed <br />to the classification of the property just south of County Road °E" <br />aInd west of Old Highway 8, to the Restricted Industrial classification. <br />Mr. Daubney stated they felt this classification would overly restrict <br />the development of this property. Mr. Daubney questioned what <br />procedure would have to be followed to develop this property while <br />the moratorium was in effect. <br />Mayor Senden stated that development at this time first required a <br />finding of consistency with the proposed Comprehensive Plan. <br />Mr,. Daubney noted that while the property is vacant there are still <br />taxes to be paid. Mr. Daubney.noted that his letter indicates that <br />a.buffered area could be established adjacent to the residential <br />property to the west. <br />
