Falcon Oil Company's variancerequestis very similar <br />to the request in Merriam Park. The $14,000.00 already invested <br />in the canopy is an extensive capital investment for a company <br />our size which will be lost if we are not permitted to erect the <br />canopy. Our business, already showing signs of deterioration <br />on inclement days, will be unable to fully compete with the <br />SuperAmerica Station across the street. Our inability to meet <br />the,setback requirement is.due to the location of our building <br />and the pump islands. The building's location and front yard <br />dimensions are unique to our property much in the same way that <br />the inadequate front yard dimensions were found to be unique <br />in Merriam Park, The only difference is that in our case <br />the building and the pump islands are already constructed, <br />causing an immediate and real hardship. In Merriam Park the <br />contractor was only preparing to construct the building. It <br />was economic feasibility (the number of units which could be <br />profitably constructed) and the lot size which allowed the <br />variance to be granted. The case of Falcon Oil is even stronger <br />because there are existing structures on the property. There is <br />no doubt that we are already suffering the adverse effects of <br />A reduction in business due to our inability to compete with <br />SuperAmerica. <br />Council requested that we determine the extent that <br />the pump islands can be moved toward the building in order to <br />reduce the amount of variance required, and that we determine <br />the costs of such a relocation.
