C Approved <br />G COMMISSION PROCEEDINGS <br />OF NEW BRIGHTON <br />Regular Meeting - July 17, 2007 at 7:00 p.m. <br />Present: Commissioners Larry Baker, Bruce Howard, Karen Mann, Tom O'Keefe, Norm Schiferl, and <br />Paul Zisla. <br />Absent: Jim O'Brien <br />Also Present: Sharon Doffing, Council Member and Janice Gundlach, City Planner. <br />Agenda Review: Agenda approved. <br />Minutes: Minutes for June 19, 2007 were approved. <br />Council Action: Council Member Doffing reported the City has a budget surplus of $545, 668.00. 't'wenty <br />percent will be allocated to reduce next year's budget and the rest of the surplus will be used in the same way <br />over the next five years. She announced that a settlement has been reached with Dr. Zelickson, the property <br />owner of the Post Office, and an agreement was reached to relocate the Post Office to the Main Street Village <br />development. She also reminded the community that National Night Out will be held on Tuesday, August 7 and <br />encouraged everyone to participate. <br />Public Hearings: LP2007-001 Site Plan Amendment <br />e applicant is requesting an amendment to the Site Plan that was approved by the Planning Commission in <br />bruary. The original land use application included a Variance, Nonconforming Use Permit, and Plat. With <br />the revised proposal the Variance is eliminated. The revised Site Plan does not impact the Nonconforming Use <br />Permit or the Plat as previously approved. The applicant has indicated the revised site plan is necessary as <br />overall project costs needed to be reduced and further programming of the interior space allowed for a reduction <br />in floor area. <br />Zisla inquired how the park dedication was determined. Gundlach replied that staff a fee of $12,278 per acre <br />would be charged. This fee was determined based on a per capita charge when comparing how many people <br />live in the City per acre and how many workers work in the City per acre. However, Council was <br />uncomfortable with that fee when applied to the Cheetah application due to specific characteristics of that <br />project. They decided to limit the fee to the acreage that was being brought into the site, which is the single- <br />family home consisting of .3 acres. The .3 acres was multiplied by the $12, 278 fee and the proposed fee was <br />established. <br />Norm Wells, Architect, stated the new plan has been fine tuned and works more efficiently than the old plan. <br />There was also a need for added room on the east side of the building for ponding that is being required by <br />MNDOT and the Rice Creek Watershed District. The Watershed District has approved the proposed pond and <br />MNDOT has been made aware of the plans.. <br />Motion by Baker, Second by Zisla to CLOSE THE PUBLIC HEARING. <br />I Aves, 0 Nays.
