Approved <br />retaining wall was built. However, when the addition is built the retaining wall would be removed and <br />iuilt entirely on his property. Baker stated that there is a typo on the survey which shows the east wall of the <br />house at eighteen feet, but it should be listed at twenty-eight feet. Schiferl asked staff if the retaining wall is an <br />issue for this application. Gundlach replied from staff's perspective the retaining wall is a civil issue that needs <br />to be addressed civilly. O'Keefe asked if it is considered nonconformity. Gundlach replied the non-conformity <br />speaks to the use of land or a setback, and since the retaining wall is not on the property it was not considered a <br />non-conforming use. Additionally, retaining walls are not required to meet a setback. <br />Doug Bankston, 1875 Skyhigh Drive, stated that he is concerned that employees or salesmen will be corning <br />and going from the property, Lloyd replied that nothing would change, except for the location of the office. <br />Mrs, Bankston stated that there are cars and trucks parked on the street all the time. Lloyd replied that he has <br />three teenage sons who have friends that park on the street when they come to use the pool and it has nothing to <br />do with his business. Mrs. Bankston replied that this is a residential neighborhood and the office shouldn't be <br />allowed. Baker replied that any parking for a home office must be kept on site and the business can have only <br />one outside employee. <br />Motion by Zisla, Second by O'Brien to CLOSE THE PUBLIC HEARING. <br />6 Ayes, 0 Nays. MOTION CARRIED. <br />Motion by Zisla, second by O'Brien RECOMMENDING APPROVAL OF THE SP2007-010 SUBJECT TO THE <br />FOLLOWING: <br />1) The building plans are amended to meet the five-foot setback. <br />2) The applicant/structure meets the home occupation conditions. <br />3) Submit revised building plans. <br />O'Keefe stated that he does not believe the playhouse has any impact on the application, is not a determent to <br />any of the surrounding buildings, and believes it should be allowed to stay where it is, Zisla replied that the <br />ordinance requires it to be moved. Baker stressed to the applicant what the home occupation rules are and with <br />the addition of the several offices it raises a red flag. Lloyd replied that he has no employees that work out of <br />the house and lie meets all of the home occupation guidelines. <br />6 ayes, 0 nays. MOTION APPROVED. <br />Public Hearing: RZ2007-001 Rezoning from MX, Mixed Use and R-3A, Multi-Family Residential to NWQ, <br />Northwest Quadrant zoning district for property generally located west of I-35W, north of 1-694, east of Long <br />Lake Regional Park and south of 14"' ST NW also known as the Northwest Quadrant <br />The City is requesting adoption of an ordinance that would rezone all property within the Northwest Quadrant <br />to NWQ, Northwest Quadrant Zoning District. The proposed property included in the rezoning request includes <br />all property west of 1-35W, north of 1-694, east of Long Lake Regional Park, and south of 14`h Street NW. Also <br />included is the Ferrell Gas site located at 1430 Old Highway 8 NW, the two parcels that made up the former <br />Co-op site located at 1427 Old I-Iighway 8 NW, and the parcel acquired from AAA Cooper for the Old Highway <br />8 detention pond. <br />0-e Planning Commission considered the NWQ zoning district at the July 17, 2007 meeting.
