SP2007-010 Special Use Permit & Nonconforming Use Permit to Allow Attached Garage to <br />llxceed 624 s.f. <br />The applicant is requesting a Special Use Permit to permit construction of an addition to the existing attached <br />garage. The existing garage is 20' x 24' or 480 square feet with the proposed addition increasing the footprint <br />to 23' x 35' or 805 square feet. Additionally, the applicant must obtain a Nonconforming Use Permit due to the <br />existing 9' x 5' "playhouse" not meeting a 5' setback to the rear lot line. This was discovered at the time the <br />applicant submitted the Certificate of Survey. <br />O'Brien asked if the second story would be added with the garage expansion. Bill Lloyd, applicant, replied that <br />it would be added with the garage expansion. O'Brien stated the plans have the rooms labeled as a library and <br />ree offices, and asked the applicant if a business would be run out of the house. Lloyd replied that he has run <br />mall construction company out of the home for the last fifteen years and this addition would allow them to <br />move the offices into the new area and remodel the rest of the house into a complete living space. O'Brien <br />asked if there would any employees at the home. Lloyd replied that he only does two projects a year within the <br />state of Minnesota; he mainly does construction outside of the state. He and his wife are the only office staff <br />and the four employees that he has are out of state. <br />Howard asked if the drive way and the garage door remain the same width as they currently constructed. Lloyd <br />replied that the garage door would be moved over so that it is centered with the new garage and the drive way <br />may increase by eighteen inches with a sidewalk going around to the back of the yard. <br />Baker stated that the survey shows that the garage will only be three feet wider, however the site plan shows the <br />garage will be twenty-four wide, which would make it four feet wider and would encroach into the side yard set <br />back. Gundlach added that the architectural plans show the addition at three feet eleven inches, which would <br />push the garage into the setback. Lloyd stated that he would make that note and change the plans. He added the <br />plans that the Commission has are preliminary and will make sure the garage conforms. Baker stated the <br />addition above the garage shows three offices and asked for a clarification, since the applicant has indicated that <br />there would only be two offices. Lloyd replied the extra room is just labeled an office, but will first be used for <br />storage and eventually used as a bonus room/home theater. Baker replied that a home office is not supposed to <br />be more than one room or twenty-five percent of one floor and this raises concerns if the entire floor is office. <br />Lloyd replied that since he has owned the home there have been two offices, just on separate floors. He also <br />added that the playhouse is small and since his property sits on a hill it would be difficult to move. He would <br />6efer to leave the playhouse where it is. <br />Howard asked if the retaining wall is the applicants or the neighbors. Lloyd replied that is his retaining wall. <br />When it was built fifteen years ago the neighbor stated the property line was in a certain area and that is where <br />Page 3 of 7
