October 9,2007- Page 4 <br />Director of Community Development Grant Fernehus explained that since 2004 the City has <br />been working with MT Properties and Minnesota Commercial. Railroad on several rail <br />projects. Negotiating has been underway since 2006. The Butchers spur was described as a <br />7.5 acre tract of land in the NWQ, currently serving one rail customer, Boulder Images, The <br />City's requested the railroad abandon that line in order to acquire the area for Northwest <br />Quadrant redevelopment. <br />A functional replacement has been requested by the railroad (300' to 400' of track to <br />accommodate three or four railcars.) The City will acquire the property from MT properties <br />for $3.35 per square foot. The difference between the Butchers Spur and the Functional <br />Replacement is $500,000. The City will also pay for the abandonment proceedings; <br />approximately $15,000- $20,000. In order to acquire lire the team track and the southeast wye the <br />City will acquire 2.65 acres from Estes Express located at 4001 Street SW. <br />Councilmember Doffing requested an explanation of the Canadian Pacific turn-out, Mr. <br />Fernelius outlined the turn out, also known as a switch <br />Councilmember Bauman requested the total amount coming out of the Municipal <br />Development fund for this project Mr. Fernelius explained it would be close to $900,000 for <br />the Estes Express acgitisition, plus the $174,000 for the construction of the team track The <br />fund balance was reported at approximately $6 million. <br />Councilmember Hoffman confirmedwith Mr. Fernelius that this was the last parcel for the <br />City to acquire in the Northwest Quadrant <br />Motion by Councilmember Hoffman, seconded by Councilmember Burg to <br />approve the attached Letter of Understanding by and between the City of New <br />Brighton; MT Properties, Inc.; and Minnesota Commercial Railway Company <br />Regarding Railroad Related Projects. <br />5 Ayes — 0 Nays, Motion Carried <br />Approval of Provisional License and Mitigation Plan for Silver Lake <br />Flats. Report No. 07 -248. (Mava fromCmsmAgenda) <br />Director of Public Safety Bob Jacobson gave an overview of the City's provisional licensing <br />practices. Director Jacobsen stated the prior owner of the property (Timbercrest) has sold the <br />property to Mr. Anthony Beasley. Improvements have been evident under the current <br />ownership. Councilmember Doffing requested clarification on the liability document utilized <br />by Silver Lake Flats. Mr. Rod Martin; representing Silver Lake Flats explained this document <br />assists the property management in the process of eviction.
