-3 - <br />We have prepared a parking plan (see attachment C) delineating <br />16 spaces, which could be obtained provided the ice shed is removed. <br />The property owner has verbally indicated that it is his intention <br />to remove the ice shed this coming spring or summer. While the 16 <br />spaces would meet Code in terms of numbers, they would be non- <br />conforming in terms of setbacks from the west and east property <br />lines. The parking plan would "free" only 1 space for display <br />purposes, if permitted, unless the area presently used for display <br />is permitted to continue. Again, we would note that it appears <br />that the sixteen spaces can only be provided if the ice shed is <br />removed. Included in these sixteen spaces are three spaces available <br />in the service area of the building, which we have normally counted <br />toward the parking requirements. Additional parking space could <br />be provided if the pump island on the south side of the building <br />were removed. The applicant has indicated, however, that this <br />pump island was going to be converted to self-service use. <br />We have prepared a second parking plan (see attachment D) <br />showing spaces that would be available if setback requirements <br />were observed. This would require that parking be set -back 30 feet <br />from Old Highway 8 and 25 feet from the western property lines. <br />Observing these setbacks would reduce the parking area that is <br />available by 6 and it appears only 10 spaces could be provided. <br />This parking plan would also require the removal of the shed. <br />Inspection of the site has revealed on occasions, a large <br />number of vehicles (approximately 15) parked on the property. <br />This tends to indicate that, unlike many service stations, there <br />may be an existing need for all of these spaces. <br />We would note that while we have consistently applied the <br />retail sales/service area approach in calculating parking for <br />service stations, the Zoning Code does not specify parking <br />requirements for service stations. There is provision in our Code <br />for the Council to determine the parking requirement for <br />uses for which parking is not specifically defined and the <br />Council may want to consider exercising this provision in this <br />particular case. <br />Applicability of Special Use Permit <br />Section 11-210 (g) states that the sale of new and used <br />automobiles is a use allowed by special permit in a B-3 district. <br />Factors to be considered in this case are: <br />1. The applicant has indicated that he has sold used <br />cars at this location since 1957. <br />
