Lewcock, City Manager <br />SUBJECT: Sewer Strength Charge <br />The Metropolitan Waste Control Commission recently instituted an <br />"industrial strength" charge system for industrial effluent exceeding <br />their standards. This strength system applies to very few industries. <br />in the metro area, but it does apply to the rendering plants. In <br />order to continue to receive EPA funds the Commission had to institute <br />the system in 1977. State law makes mandatory the adoption of the <br />Commission's formula by municipalities. <br />While the City's sewer ordinance makes provision for strength charges, <br />several changes are needed to insure its legality. The attached <br />proposed ordinance makes changes to Section 265:20, Subd. 4, in order <br />to accomplish this purpose. Further the Commission has developed a <br />joint powers agreement (also attached) permitting them to directly bill <br />and collect strength charges. The Commission would prefer direct <br />billing and we believe it would eliminate the need for additional <br />administrative overhead on our part as well as remove us from being <br />a third party to the new system. <br />The Commission has informed us that the ordinances and resolutions <br />required on our part must be adopted by January 1. Because of the <br />late date of receipt from the Commission, this would appear impossible. <br />Should the Council hold the first reading of the ordinance on Dec. 28, <br />we would inform the Commission of our intent to comply and that the <br />required documents would be filed with them by mid Janaury. <br />Thomas F.
