December 13, 1976
TO: The Honorable Mayor and Members of the Council
FROM: Thomas F. Lewcock, City Manager
SUBJECT: Sewer Strength Charge
The Metropolitan Waste Control Commission recently instituted an
"industrial strength" charge system for industrial effluent exceeding
their standards. This strength system applies to very few industries.
in the metro area, but it does apply to the rendering plants. In
order to continue to receive EPA funds the Commission had to institute
the system in 1977. State law makes mandatory the adoption of the
Commission's formula by municipalities.
While the City's sewer ordinance makes provision for strength charges,
several changes are needed to insure its legality. The attached
proposed ordinance makes changes to Section 265:20, Subd. 4, in order
to accomplish this purpose. Further the Commission has developed a
joint powers agreement (also attached) permitting them to directly bill
and collect strength charges. The Commission would prefer direct
billing and we believe it would eliminate the need for additional
administrative overhead on our part as well as remove us from being
a third party to the new system.
The Commission has informed us that the ordinances and resolutions
required on our part must be adopted by January 1. Because of the
late date of receipt from the Commission, this would appear impossible.
Should the Council hold the first reading of the ordinance on Dec. 28,
we would inform the Commission of our intent to comply and that the
required documents would be filed with them by mid Janaury.
Thomas F. Lewcock
City Manager
