Kleinschmidt, Director of Public Works RE: Technical and Engineering Assistance Agreement and Agency Agreement with Minnesota Highway Department Enclosed you will find the following: 1. Two copies of Technical and Engineering Assistance Agreement 2. Two copies of an Agency Contract The first item above is a standard yearly agreement with MHD. Included with this is a resolution authorizing the City Engineer to request such assistance when needed. Each City and County in the State is asked to pass this resolution and sign this agreement. I believe all (or most of them) do this. New Brighton did this last year and perhaps for the last several years. If the City is in a position where assistance is needed from the State Highway Department, the City can get this assistance without further Council action. I may want to have traffic counters fixed or I may want to consult with State Hydraulic Engineers or Traffic Engineers regarding Council originated projects. They do not want to supply this assistance unless they have a signed agreement and executed resolution on file. They then will bill the City for these services at their usual rates. The second item above is an Agency Contract. This again is an annual agreement whereby the City designates the Commissioner of Highways as its agent in accepting Federal Aid on behalf of the City for road and bridge construction where Federal Aid is involved. We have had no Federal Aid highway projects this year and I anti- cipate none next year. Also included with this agreement is a resolution designating the Commissioner of Highways as agent for the City in letting contracts for road and bridge construction where Federal Aid is involved.
