December 17, 1976 <br />TO: Thomas F. Lewcock, City Manager <br />FROM: James J. Kleinschmidt, Director of Public Works <br />RE: Technical and Engineering Assistance Agreement and Agency <br />Agreement with Minnesota Highway Department <br />Enclosed you will find the following: <br />1. Two copies of Technical and Engineering Assistance Agreement <br />2. Two copies of an Agency Contract <br />The first item above is a standard yearly agreement with MHD. <br />Included with this is a resolution authorizing the City Engineer <br />to request such assistance when needed. Each City and County in the <br />State is asked to pass this resolution and sign this agreement. I <br />believe all (or most of them) do this. New Brighton did this last <br />year and perhaps for the last several years. If the City is in <br />a position where assistance is needed from the State Highway <br />Department, the City can get this assistance without further Council <br />action. I may want to have traffic counters fixed or I may want <br />to consult with State Hydraulic Engineers or Traffic Engineers <br />regarding Council originated projects. They do not want to supply <br />this assistance unless they have a signed agreement and executed <br />resolution on file. They then will bill the City for these services <br />at their usual rates. <br />The second item above is an Agency Contract. This again is an <br />annual agreement whereby the City designates the Commissioner of <br />Highways as its agent in accepting Federal Aid on behalf of the <br />City for road and bridge construction where Federal Aid is involved. <br />We have had no Federal Aid highway projects this year and I anti- <br />cipate none next year. Also included with this agreement is a <br />resolution designating the Commissioner of Highways as agent for <br />the City in letting contracts for road and bridge construction where <br />Federal Aid is involved. <br />I recommend passage of both resolutions and signing of both <br />agreements. <br />e <br />James .
