Council Proceedings <br />City of New Brighton <br />Nov. 23, 1976 <br />Motion by Hardt, seconded by Fisher to receive <br />administrative report dated Nov. 18, 1976, re: <br />offensive trades license, Mengelkoch. <br />5 ayes- 0 nayes- carried <br />The Building and Planning Coordinator noted to the Council <br />that he had _reviewed the proposed resolution with the <br />applicant and an amended resolution had been prepared <br />changing certain wording, but not making substantive <br />changes. The Building and Planning Coordinator reviewed <br />the changes with the Council. <br />Mr. G. Robert Johnson, attorney for Mengelkoch, stated he <br />had certain changes he would like to recommend to the <br />Council, those changes were as follows: <br />Offensive <br />Trades <br />Mengelkoch <br />1. The 4th WHEREAS change - "said tests were rejected by" to <br />"said tests were found to be unsatisfactory by" <br />2. To delete the 5th WHEREAS <br />3. To change the 6th WHEREAS by eliminating the words <br />"health and safety" <br />4. Item No. 4, change "be kept closed so" to <br />"be kept closed during periods of operation so" <br />5. Change Item 2c from March 1,1976 to March 1, 1977 and <br />that some words be changed so as to give the company <br />certain rights in the selection of testing firms <br />6. Item 2(g)to change statement re: APC 9 to read <br />"applicable portion of APC 9" <br />7. Item 3 should specifically state that suspension <br />occurs when the City knows the operator has caused a <br />sewage problem <br />Motion by Hardt, seconded by Fisher to close discussion <br />at 11:45. <br />3 ayes - 2 nayes (Senden,Bromander) - carried <br />Motion by Hardt, seconded by Wrrdouschwgg to direct the <br />following changes to be made in the proposed resolution: <br />1, The 4th WHEREAS change "said tests were rejected by: to <br />"said tests were found to be unsatisfactory by" <br />2. Item No. 4, change "be kept closed so" to <br />"be kept closed during periods of operation so" <br />
