Council Proceedings City of New Brighton Nov. 23, 1976 Motion by Hardt, seconded by Fisher to receive administrative report dated Nov. 18, 1976, re: offensive trades license, Mengelkoch. 5 ayes- 0 nayes- carried The Building and Planning Coordinator noted to the Council that he had _reviewed the proposed resolution with the applicant and an amended resolution had been prepared changing certain wording, but not making substantive changes. The Building and Planning Coordinator reviewed the changes with the Council. Mr. G. Robert Johnson, attorney for Mengelkoch, stated he had certain changes he would like to recommend to the Council, those changes were as follows: Offensive Trades Mengelkoch 1. The 4th WHEREAS change - "said tests were rejected by" to "said tests were found to be unsatisfactory by" 2. To delete the 5th WHEREAS 3. To change the 6th WHEREAS by eliminating the words "health and safety" 4. Item No. 4, change "be kept closed so" to "be kept closed during periods of operation so" 5. Change Item 2c from March 1,1976 to March 1, 1977 and that some words be changed so as to give the company certain rights in the selection of testing firms 6. Item 2(g)to change statement re: APC 9 to read "applicable portion of APC 9" 7. Item 3 should specifically state that suspension occurs when the City knows the operator has caused a sewage problem Motion by Hardt, seconded by Fisher to close discussion at 11:45. 3 ayes - 2 nayes (Senden,Bromander) - carried Motion by Hardt, seconded by Wrrdouschwgg to direct the following changes to be made in the proposed resolution: 1, The 4th WHEREAS change "said tests were rejected by: to "said tests were found to be unsatisfactory by" 2.
