• RESOLUTION NO.
STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF AN AMENDMENT TO SITE PLAN
LP2006-001 DOCUMENTED UNDER RESOLUTION ##06-029.

WHEREAS, an application has been made by FW Gordon Construction to be considered for an
amendment to a previously approved Site Plan, which revises the materials proposed for the
exterior of the building at 1820 Old Highway 8 NW, known as the Rush Lake office building.

WHEREAS, the procedural history of the application is as follows:
1. The City Council approved LP2005-006 on April 26, 2005.
2. The City Council approved LP2006-001 on March 28, 2006.
3. An application for a Site Plan Amendment was received on November 2, 2007.
4. The Planning Commission provided a recommendation of the proposal on November 20,
2007.
5. The City Council considered the request on November 27, 2007.

WHEREAS, the Planning Commission and City Council make the following Findings of Fact with
respect to the amended Site Plan (LP2007-012):
. 1. The Site Plan was previously approved in Resolution 06-029 and outlines development of the
site in compliance with the MX district standards.
2. Resolution 06-029 reflects the re-approval of the Site Plan and Special Use Permit originally
approved and documented under Resolution 05-036.
3. The revised building elevations are consistent with the General Performance standards noted
in Section 6-390.
4. The revised building elevations are consistent with the MX district performance standards of
Section 6-570 (2), provided the applicant breaks up the western fagade with a secondary
building material.
5. The exterior cornice element must remain, although it can consist of a material that imitates
stone, and must wrap around the entire building between the 2nd and 3rd floors.
6. The amended Site Plan does not impact any other zoning requirements as to building height,
setbacks, floor area ratios, parking, etc.
7. The proposed revision does not impact any of the conditions noted in Resolution 06-029.

Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for
a Site Plan Amendment (LP2007-012) is hereby approved in accordance with attached Exhibit
A, subject to the following condition:
1. Continued compliance with Resolutions 06-029.

I:\Co t NCILIREPOR'hS\2007\Comnnmity Development\11-27-2007`,.LP2007-012 (FW Gordon) - RE?SOLLITION.doc 1
