<br /> r <br /> <br /> <br /> <br /> <br /> RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF AN AMENDMENT TO <br /> SITE PLAN LP2006-001 DOCUMENTED UNDER RESOLUTION #06-029. <br /> <br /> WHEREAS, an application has been made by FW Gordon Construction to be considered for an <br /> amendment to a previously approved Site Plan, which revises the materials proposed for the <br /> exterior of the building at 1820 Old Highway 8 NW, known as the Rush Lake office building. <br /> WHEREAS, the procedural history of the application is as follows: <br /> 1. The City Council approved LP2005-006 on April 26, 2005. <br /> 2. The City Council approved LP2006-001 on March 28, 2006. <br /> 3. An application for a Site Plan Amendment was received on November 2, 2007. <br /> 4. The Planning Commission considered the amended Site Plan on November 20, 2007. <br /> <br /> WHEREAS, the Planning Commission makes the following Findings of Fact with respect to <br /> amended LP2007-012: <br /> 1. The Site Plan was previously approved in Resolution 06-029 and outlines development of the <br /> site in compliance with the MX district standards. <br /> 2. Resolution 06-029 reflects the re-approval of the Site Plan and Special Use Permit originally <br /> approved and documented under Resolution 05-036. <br /> <br /> 3. The proposed amendment to revise the materials proposed for the north, south and west <br /> building elevations is consistent with the General Performance standards noted in Section 6- <br /> 390. <br /> 4. The Planning Commission finds the proposed revision to the exterior materials of the east <br /> elevation (street side) is not compliant with the General Performance standards noted in <br /> Section 6-390. <br /> 5. The removal of the stone previously proposed makes the building appear more residential in <br /> nature, rather than commercial. <br /> 6. The proposed elimination of the exterior cornice element wrapping around the building <br /> between the 2nd and 3`d floors does not honor the concepts originally proposed for the <br /> building. <br /> 7. The amended Site Plan does not impact any other zoning requirements as to building height, <br /> setbacks, floor area ratios, parking, etc. <br /> 8. The proposed revision does not impact any of the conditions noted in Resolution 06-029. <br /> <br /> NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Site Plan Amendment (LP2007-012) is hereby recommended to the City Council for approval <br /> subject to the following conditions: <br /> 1. The east elevation is constructed with exterior materials consistent with the plan <br /> approved on March 28, 2006 in terms of the amount of stone, <br /> • 2. The exterior cornice element remains between the 2nd and 3`d floors wrapping around the <br /> entire building, as depicted on the March 2006 and April 2005 plans. <br /> 3.
