<br />, <br /> <br />I <br />I. .. <br />'I <br />" <br />" <br /> <br />RESOLUTION No. 05-030 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING PRDOS-OI, LPOS-OI, <br />and PL05-0 1 <br /> <br />WHEREAS, an application has been made by Mr. Ted Redmond, ofBKV Group, on behalf of <br />the Clifton House to be considered for a preliminary PRD review by the City Planning <br />Commission. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />I.An application for PRD, Site Plan, and Preliminary Plat was filed with the City of New <br />Brighton on December 22,2004, <br />2.A Public Hearing Notice was published in the New Brighton Bulletin on January 4, 2005. <br /> <br />3.Public hearing notification was distributed to all property owners within 600 feet of the <br />subject site. <br />4.The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on January 18, 200S and all persons present at the hearing were given an opportunity to be <br />heard. <br />S.The Planning Commission considered the plans and recommended preliminary review <br />approval subject to conditions. <br />6.0n January 25, 2005, the City Council considered the application and tabled the application <br />allowing the applicant to re-design the site plan. <br />7.0n April 26, 2005 the Council approved a preliminary PRD with conditions. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect to PRDOS-Ol, <br />LPOS-Ol, and PLOS-Ol: <br />l.The site is zoned R-l. <br /> <br />2.Under a Planned Residential Development preliminary approval process, increased density, <br />height limitations, and land uses are reviewed and considered. <br /> <br />'3.The application has gone through the PRD Review Process and the Planning Commission <br />has recommended the Preliminary Review to the City Council. <br /> <br />4.The proposed units for the PRD include 6 proposed convalescence units and three <br />visitor/meditation units to treat the health and healing of Christian Science faith practitioners. <br /> <br />5.As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall fmd: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />b. That the special use will not be itliurious to the use and enjoyment of other property <br />in the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. . <br />c.
