Per Section 4-600 (4) of the New Brighton Zoning Ordinance, wireless <br />Ii telecommunication towers/antenna are subject to the approval of a special use permit; and <br />II <br />it . <br />!I <br />!WHEREAS, the procedural history of the application is as follows: <br /> <br />i i 1. An application for a special use permit was filed with the City of New Brighton on April <br />H 30, 2004. <br />i i 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />II ~~a~~y 18, 2004, and all persons present at the hearing were given an opportunity to be <br /> <br />Ii 3. The New Brighton Parks, Recreation, and Environmental Commission considered the <br />II application on June 2, 2004 and endorsed the Planning Commission's recommendation to <br />i i the Council. <br />! 4. The City Council considered the request at the June 22, 2004 meeting. <br />H <br />;i <br />:i <br /> <br />RESOLUTION NO. 04-051 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />1; <br /> <br />iNow THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SP04-06: <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br /> <br />2. The applicant is requesting a Special Use Permit to construct a 65-foot tower. <br />3. Within Section 4-600 (4) wireless telecommunication towers/antenna are subject to <br />approval of a special use permit and meet the standards of Section 4-600 (2): <br /> <br />a. All towers and antennae shall have setbacks equal to or greater than the height of <br />the proposed structure. <br />b. The distance of any guy anchorage or similar device shall be at least ten feet from <br />any property line. <br />c. Suitable protective anti-climb fencing and a landscape planting screen shall be <br />provided and maintained around the structure and accessory attachments. <br /> <br />d. The applicant shall present documentation of the possession of any required <br />license by any Federal, State, or local agency. <br />e. No structure shall be in excess of a height equal to the distance from the base of <br />the structure to the nearest overhead electrical power line which serves more than <br />I dwelling or place of business, less five feet. <br /> <br />f.
