Application for the permit must include construction drawings showing proposed <br />method of installation, structural engineering analysis, and a site plan depicting <br />structures and plantings on the property and all adjacent properties. At the request <br />of the administrative authority, documentation of a maintenance program may be <br />required. <br /> <br />h. If any modifications are made to the structure, the City shan have the authority to <br />require proof that the addition, change, or modification is in conformity with the <br />permit and the Uniform Building Code. <br /> <br />i. The owner of such a structure shall assume complete liability in case of personal <br />or property damage. <br /> <br />4. An performance standards in Section 4-600 (2) listed above have been satisfied. <br /> <br />5. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use <br />shall be recommended by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not <br />be detrimental to or endanger the public health, safety, morals, comfort of <br />general public. <br />b. That the special use win not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for uses <br />permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />e. That the special use shan, in all other respects, conform to the applicable <br />regulations of the district in which it located. <br /> <br />6. The Planning Commission held a public hearing and found the above criteria to be <br />satisfied and unanimously recommended approval to the City Council. <br />7. On June 22, 2004, the City Council finds the special use standards satisfied. <br /> <br />~E IT FuRTHER RESOLVED, that based upon the above findings of fact, the application SP04~06 is <br />hereby approved with the following conditions: <br /> <br />1. The applicant shall re-configure the planting plan to provide screening to the west and south <br />to be approved by the City Planner. <br />2. Compliance with an FCC regulations. <br />3. The lease arrangement shan be subject to review and approval of City staff, City Council <br />and the City Attorney. <br />4.
