November 27,2007- Page 4 <br />Staff reviewed the Site Plan with regard to use, building & parking setbacks, parking <br />standards, floor area ratio, exterior building materials, lighting, landscaping and signage <br />and found the plan to fully comply with all Zoning Code requirements. <br />Councilmember Bauman questioned the function of the meeting room included in the plans <br />submitted John Hafner representing City's Edge Architects stated that the intent of the meeting <br />room is primarily for the use of the hotel guests for meeting and training purposes. <br />Motion by Councilmember Bauman, seconded by Councilmember Hoffman to adopt the attached <br />Resolution approving the requests subject to 4 conditions. <br />4 Ayes — 0 Nays, Motion Carried <br />5. City of New Brighton requests a Zoning Code amendment impacting Zoning Code <br />Sections 6-050 and 6-140 regarding allowance of accessory structures in excess of 40 <br />feet in height by Special Use Permit. Report No. 07 -298. <br />The City Planner, Janice Gundlach explained that this amendment would allow certain industr <br />properties to have accessory structures in excess of 40 feet in height; this amendment would <br />benefit six properties in the City. The amendment proposes nine conditions including that the <br />site is located adjacent to I -35W, the structure is placed in the side or rear yard, meets <br />principal structure setbacks, adjacent property is not zoned for residential, the <br />structure is located at least 10' from the principal structure, the site is at least 5 acres, <br />and a cap on the total height. Additionally, the general Special Use Permit <br />standards are required as well as compliance with all performance standards of Section <br />6- 390.Staff feels adequate controls are in place to regulate this use and would rec( <br />adoption of the attached Ordinance. <br />Motion by Councilmember Hofhnan, seconded by Councilmember Bauman to adopt the attached <br />Ordinance amending Zoning Code Sections 6 -050 and 6 -140. <br />4 Ayes — 0 Nays, Motion Carried <br />6. Resolution No. 07 -122. <br />The City Planner, Janice Gundlach explained this item is directly associated with the <br />previous item authorizing the zoning code amendment. Staff reviewed the Special Use Permit <br />against the conditions proposed under the code amendment to Section 6 -050 as well <br />as the general health, safety and welfare standards of Section 8 -130. Staff finds all <br />criteria have been met subject to the applicant performing certain site maintenance <br />which he has agreed to. <br />5.
