November 27,2007- Page 5 Motion by Councilmember Bauman, seconded by Councilmember Burg to adopt the attached Resolution approving the Site Plan and Special Use Permit subject to 3 conditions, outlined in the attached Resolution. 4 Ayes - 0 Nays, Motion Carried 7. City of New Brighton requests Preliminary and Final Plat approval for property located at 4001st Street SW to facilitate construction of a railroad wye and team track Report No. 07 -300. Resolution No. 07 -123. The City Planner, Janice Gundlach, provided an overview of the proposedproject, The City is requesting Preliminary and Final Plat approval in order to create three lots on one block, and one outlot, to be known as ESTES EXPRESS ADDITION. This request will facilitate construction of a railroad wye, on proposed Lot 2, and allow relocation of the lone user of the Butcher's Spur within the Northwest Quadrant redevelopment area, on proposed Lot 1. The remaining land, proposed Lot 3, will be retained by current owner (Estes Express Lines) and Outlot A will be retained by the City. Lastly, a Ponding and Flowage Easement will be dedicated over entire Outlot A to accommodate the existing drainage pond and a Drainage and Utility Easement will be dedicated across proposed Lots 1 and 2 for the existing pipe owned by Estes Express and originates on proposed Lot 3. The City Council approved a Minor Subdivision on September 11, 2007 for a subdivision identical to this plat. However, Ramsey County rejected to legal descriptions proposed by the Minor Subdivision due to the underlying descriptions existing in both abstract and torrens. This plat is necessary to satisfy Ramsey County's Registrar of Titles. Motion by Councilmember Burg, seconded by Councilmember Hoffman to adopt the attached Resolution approving the Preliminary and Final Plat to be known as ESTES EXPRESS ADDITION. 4 Ayes - 0 Nays, Motion Carried 8. Authorize Mayor Larson s travel to ICMA conference. Report No. 07 -290. Counci member Bauman requested approval for travel be approved prior to the travel in addition to providing a statement of associated expenses. Mayor Larson reported that while he has been on three trips in 2007, the trip to San Antonio was at no cost to the City. Councilmember Hoffinan suggested reviewing the policy for consistency.
