RESOLUTION No. 07-095 <br />STATE OF MINNESOTA <br />1 COUNTY OF RAMSEY <br />i <br />CI'ITY of NEW BRIGHTON <br />RESOLOON MAKING FINDINGS OF FACT AND APPROVING OF A SPECIAL USE PERMIT AND <br />NONCbKFORMING USE PERMIT. <br />THERE s, an application has been made by Bill and Maria Lloyd to permit construction of an <br />additi#I to the existing attached garage whereby the total square footage would exceed 624 s.f. at <br />1901 �j yhigh Drive, and <br />WHERE, the procedural history of the application is as follows: <br />1. A pplication for a Special Use Permit was received on August 2, 2007. <br />2. Fol owing submission of the Certificate of Survey it was determined by staff that a <br />No conforming Use Permit would also be necessary. <br />3. Tht Planning Commission, pursuant to published and mailed notices, held a public hearing <br />onlAugust 21, 2007 and all present were given a chance to freely speak at the hearing. <br />4. T: <br />fc <br />a. <br />BcouP <br />S, the Planning Commission and City Council make the following Findings of Fact with <br />to the Special Use Permit (SP2007-010) and Nonconforming Use Permit (NC2007-003): <br />property is zoned R-1, Single Family Residential. <br />property is guided in the Comprehensive Plan for Low Density Residential. <br />property is legally described as follows: <br />Lot 7, Block 3, VALLEY VIEW PARK <br />applicant has proposed to construct an addition to the existing attached garage whereby <br />total square footage would exceed 624 square feet at 805 square feet. <br />Planning Commission and Council considered the proposal in accordance with Zoning <br />le Section 4-530 (1) (E) which requires approval of a Special Use Permit for any <br />-ssory building in excess of 624 square feet. <br />Planning Commission and Council considered the proposed Special Use Permit in <br />ardance with Zoning Code Section 4-530 (1) (K) which requires that the detached garage <br />A the following conditions: <br />Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />Planning Commission and Council reviewed the proposal in accordance with the <br />owing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />Dcvelopmentl8-28-2007\.SP2007-010, NC2007-003 (Lloyd) - RESOLUTION.doe <br />
