Motion Approved. <br />Public Hearing: NC2008-001 Nonconforming Use Permit for 1230 Long Lake Road <br />Regarding an Existing Front Yard Setback <br />The applicant is requesting approval of a Nonconforming Use Permit for property located at <br />1230 Long Lake Road. The nonconformity consists of a front yard setback of approximately 28' <br />where 30' is required. The property sustained fire damage on December 23, 2007. As part of <br />the restoration the owners would like to replace the existing half story with roof trusses that <br />result in a taller second story with more livable space. This improvement coupled with the <br />existing nonconforming front yard setback constitutes an expansion of a nonconforming use. <br />Zisla asked if the shed is on a foundation. Lahr replied that is not on a foundation, and it would <br />be moved to meet the condition. <br />Motion by O'Brien, second by Schiferl to CLOSE THE PUBLIC HEARING. <br />7 ayes, 0 nays. Motion Approved. <br />Public Hearing: LP2008-002, ZA2008-001 Site Plan and Zoning Code Amendment <br />Facilitation Various Site Improvements at 2051 Silver Lake Road, Including a Drive — <br />Thru. <br />The applicant has requested a Site Plan allowing several site improvements to the Hollywood <br />Video site at 2051 Silver Lake Road, most notably the addition of a drive-thru lane at the south <br />end of the building. Additionally, the applicant has requested a Zoning Code amendment that <br />would legally allow the existing 15' setback (side street yard parking lot) adjacent to Rice Creek <br />Road. <br />Schiferl asked if the neighbors within the 350 -foot radius were notified of this proposal. <br />Gundlach replied that since the current proposal is a site plan it does not require notification, <br />however if the code amendment is approved the special use permit would require notification. <br />O'Keefe asked if a left turn is prohibited in the northern exit. The applicant replied that there is a <br />median that would block that turn. O'Keefe stated that he would like staff to verify with the <br />Public Works Department that they are aware that the options to go south from this building are <br />
