u <br />RESOLUTION NO. <br />07-043 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A PARTIAL RIGHT-OF-WAY <br />ks, an application has been made by the City of New Brighton, in cooperation with Norm <br />and Manfred Niedernhoefer, for a partial right-of-way Vacation of Mounds Avenue, that <br />1 of which intersects at Old Highway 8 NW. <br />i, the procedural history of the application is as follows: <br />Public hearing notices for the right-of-way vacation were published in the New Brighton <br />Bulletin on February 7, 2007. <br />Public hearing notification was distributed to all property owners within 350' of the <br />subject property. <br />The Planning Commission, pursuant to published and mailed notices, held on a public <br />hearing on February 20, 2007. <br />The Planning Commission recommended conditional approval to the City Council for the <br />partial right-of-way vacation on February 20, 2007. <br />The City Council reviewed the request on April 10, 2007 and tabled action. <br />The City Council continued discussion on May 8, 2007 and approved the request subject <br />to conditions. <br />s, the Planning Commission and Council make the following Findings of Fact with <br />to VA2007-001: <br />The eastern approximately 165' of Mounds Avenue was vacated previously per <br />Document #2837905. <br />The portion proposed to be vacated is legally described as follows: <br />That part of MOUNDS AVENUE as dedicated in the plat of MOUNDS CENTER, <br />which lies easterly of the east right of way line of County State Aid Highway No. 77 <br />and westerly of a line drawn perpendicular to the north line of MOUNDS AVENUE <br />from the southwest corner of Lot 14, Block 4, MOUNDS CETNER, according to the <br />recorded plat thereof. <br />The partial vacation means the City will retain its right to keep and maintain existing <br />water and sanitary sewer utilities. <br />The Mounds Avenue roadway provides access to two different owners: Cheetah <br />Precision, 2023 Old Highway 8 NW/52 Mounds Avenue/55 Mounds Avenue, and an <br />office user at 2044 Old Highway 8 NW. <br />The property at 2044 Old Highway 8 NW has frontage along Old Highway 8 NW. <br />Cheetah Precision and 2044 Old Highway 8 NW have agreed to enter into a Shared <br />Access & Maintenance Agreement. <br />Development15-8-20071VA2007-001 (City & Cheetah Precision) - RESOLUTION.doc i <br />
