Now' <br />Cheetah Precision has made a separate application to re -plat 2023 Old Highway 8 NW, <br />52 Mounds Avenue, and 55 Mounds Avenue into one lot on one block, to be known as <br />NIEDERNHOEFER ADDITION. <br />The Planning Commission held a public hearing on the right-of-way vacation on <br />February 20, 2007 and all persons were given the opportunity to be heard. <br />The Council considered the request on April 10, 2007 and May 8, 2007. <br />EREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br />partial right-of-way Vacation (VA2007-001) is hereby approved subject to the following <br />The City retains its right to keep and maintain water and sanitary sewer utilities within <br />the 60' wide platted area. <br />A legally binding Shared Access & Maintenance Agreement is reached between Cheetah <br />Precision and the property owner at 2044 Old Highway 8 NW. This agreement shall be <br />recorded against the title of both properties and extend to future owners. The agreement <br />shall be submitted to the City for review by the City Attorney. <br />Cheetah Precision's land use applications PL2007-001, FP2007-001, LP2007-001, and <br />NC2007-001 are approved and the plat, known as NIEDERNHOEFER ADDITION, is <br />recorded in conjunction with this Resolution. <br />this 8a' day of May, 2007. <br />-- <br />Steve Larson, Mayor <br />T: Dean R.
