<br />. ,. <br /> <br />; <br />! i <br />~ ; <br /> <br />RESOLUTION No <br />STATE OF MINNES <br />COUNTY OF RAMs <br />CITY OF NEW BRIG <br /> <br /> <br />:f-l,ESOLUTJON MAKING FINDINGS OF FACT AND APPROVAL OF V ARIACNE AND SPECIAL USE PERMIT <br />; VN03-01, SP03-08, & LP03-06: <br />1 <br /> <br />WHEREAS, an application has been made by John Oliver & A sociates for Mr. Aleksey Zaytsev to be <br />I considered for a variance and special use permit to construe an automotive repair facility at 13 2nd <br />Avenue SE. <br /> <br />WHEREAS, the procedural history of the application is as foll ws: <br /> <br />1. John Oliver & Associates applied for a one fi at side yard building setback and four <br />parking stall variance October 3, 2003. <br />2. The applicants also applied for a special use ermit to allow an automotive repair facility <br />at the site. <br />3. The Planning Commission, pursuant to publ shed and mailed notices, held a public <br />hearing on October 21,2003, and all person present at the hearing were given an <br />opportunity to be heard, <br />4. The City Council heard the proposal and ap roved of the five parking stall and one foot <br />building setback variance and a special use ermit for automotive repair use. <br /> <br />; WHEREAS, the City Council makes the following Findings fFact in respect to VN03-01, SP03-08, & <br />!. LP03-06: <br />1, The subject site is presently a vacant lot. <br />2. The subject site is zoned I-I, Light Industrial. <br />3. The Comprehensive Plan designation for the subje t site is LI, Light Industrial. <br />4. The proposed continued use ofland is consistent ith the Comprehensive Guide Plan. <br />5. Automotive repair facilities are a special use in the I-I, light industrial zone. As specified in <br />Section 8-130 of the New Brighton Zoning Ordina ce, no special use shall be approved by the <br />Council unless such shall find: <br /> <br />a. That the establishment, maintenan e, or operations of the special use will not be <br />detrimental to or endanger the pub ic health, safety, morals, comfort of general <br />public. <br />b. That the special use will not be inj rious to the use and enjoyment of other <br />property in the immediate vicinity for the PUl1'oses already permitted, nor <br />substantially diminish and impair roperty values within the neighborhood. <br />c. That the establishment of the spec al use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />d, That adequate utilities, access roa s, drainage and/or necessary facilities have been <br />or are being provided. <br />e.
