<br />. . <br /> <br />I <br /> <br />i i <br /> <br />6.The City Council finds the submitted plans to satisfy the c teria listed above. <br /> <br /> <br />7.The City of New Brighton Zoning Ordinance, Section 6-06 requires a fifteen foot side yard building <br />setback. <br />8. The city of New Brighton Zoning Ordinance, Section 1-030 (3) K, requires 15 parking stalls; the <br />applicant is proposing to develop the site with 14 parki g stalls. <br />9. Where there are practical difficulties or unusual hards ips in the way of carrying out the strict <br />letter of the provisions of the City of New Brighton Zing Ordinance, the Council shall have the <br />power, in a specific case, to permit a variance from th provisions ofthis ordinance. The crucial <br />points of the variance are: <br /> <br />a. Undue hardship <br />b. Unique circumstances <br />c. Conformance with the Comprehensive PIa <br />d. Variance shall not be detrimental to adjace <br /> <br />10. The City of New Brighton vacated Clinton Street SE, <br />utility easement along the applicant's property. <br />11. The easement area comprises 42.8% of the entire site. <br />12. The plight of the property owner is due to circumstan es unique to the property in question and <br />was not created by the applicant. <br />13. The requested variance conforms to the comprehensiv plan and would not be detrimental to <br />adjacent property owners or the public as a whole. <br />14.
