RESOLUTION NO. <br />08-042 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND DENYING A SPECIAL USE PERMIT. <br />an application has been made by Northwest Youth & Family Services to permit <br />of an education and day treatment program in 31,400 s.f. of existing space at 520 <br />❑ty Road D, and <br />7HE AS, the procedural history of the application is as follows: <br />1. i application for a Special Use Permit was received on February 28, 2008. <br />2. he Planning Commission, pursuant to published and mailed notices, held a public hearing <br />March 18, 2008 and all present were given a chance to freely speak at the hearing. <br />3. le Planning Commission recommended approval on March 18, 2008. <br />4. le City Council considered the request on March 25, 2008, and directed staff to draft a <br />vial resolution. <br />5. e City Council considered several findings of fact in support of denying the requested <br />ecial Use Permit. <br />fHEI EAS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2008-004): <br />1. e property is zoned I-2, Heavy Industrial. <br />2. e property is guided in the Comprehensive Plan for Light Industrial. <br />3. e property is legally described on attached Exhibit A. <br />4. a applicant has proposed to operate an education and day treatment program in 31,400 s.f <br />existing space at 520 West County Road D. <br />5. le education and day treatment program would accommodate a maximum of 60 students <br />d up to 35 staff members. <br />6. Section 6-140 (5) any use not listed in the I-2 standards may be considered by approval <br />a Special Use Permit. <br />7. a Planning Commission and Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />III That the special use will not be injurious to the use and enjoyment of other property in <br />j the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />I impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />III That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />I; being provided. <br />De elopmmt%4-8-200KSP2008-004 (Northwest Youth & Family Service) - RESOLLMONAc <br />1 <br />
