Approved <br />conforming and no conditions need to be placed on it in order for the application to receive <br />. approval. Whereas, a special use permit allows conditions to be placed as deemed necessary to <br />ensure that there are no negative impacts by the development. If a site plan meets all codes then <br />the City must automatically approve the application and no notice is sent to neighbors. <br />Gerry Gilman, 2398 Rice Creek Road, stated that she has numerous concerns regarding the drive <br />thru. They currently have some light and noise issues from the current use and believe the drive <br />thru would increase the noise level. She also believes that by pushing all the cars out to Rice <br />Creek Road it would create a logistical issue. She is concerned that the proposed six foot tall <br />fence would not be sufficient and is worried that the light from the cars will be directed into their <br />bedroom window. <br />Jim Try, 2443 Mounds Avenue, stated at the last Council meeting several Council Members <br />were worried with the incoming traffic coming only from Silver Lake Road, that it may create <br />traffic issues. He added that several neighbors are worried if a restaurant should go in that the <br />garbage could become an issue. He requested that if a fire door is required, that it is an <br />emergency only exit door with alarm, so employees are not able to use the back entrance to <br />smoke or loiter. Schiferl asked if headlights have been an issue for his property. Try replied that <br />he currently does not have an issue with headlights on his property; however he does know that <br />the two houses to the north have had issues with headlights shinning into the residences. <br />Jeff Wrede, Momentum Design Group, stated that the proposed drive thru would be a beneficial <br />traffic change and would eliminate any traffic hazards. He added that the City Code would only <br />• allow a six-foot fence, however they will be transplanting several large evergreen trees to also <br />help block any headlights. There would be wet and dry garbage, but would make sure that it is <br />picked up regularly. There will be emergency exits added according the IBC and would add <br />detect alarms to the doors, which will sound if the doors are opened. They would also add lamp <br />shields to the lights that face the north to help control the light spillage into the neighbor's yards. <br />Schiferl asked if the applicant could address the issue of headlights shining into residences to the <br />north and improve the landscaping along the back wall and on the north end of the property. <br />Wrede replied that there is a privacy fence along the north and the grade drops off at the end of <br />the property, which causes the fence to sit at the lowest point of the property, but would look into <br />improving it. <br />Motion by Baker, second by Schiferl to CONTINUE THE PUBLIC MEEITNG TO THE APRIL 15TH <br />PLANNING COMMISSION MEETING. <br />5 ayes, 0 nays. Motion Approved. <br />Public Hearing: LP2008-003, SP2008-005 Site Plan and Special Use Permit to permit an <br />addition to the existing car wash bay located at 201 West County Road E2 <br />The applicant is requesting Site Plan and Special Use Permit approval in order to construct a 10' <br />• x 18' addition to the north end of the existing car wash bay. The Commission may recall that the <br />applicant originally applied for a Special Use Permit in January to allow removal of a condition <br />
