The parties have now reached a tentative settlement. We <br />believe the settlement is consistent with previous Council direction. <br />Because the Council has not yet seen the proposed settlement agreement, staff has asked <br />that the document be kept confidential until the regular meeting. Jack Harper has prepared the <br />attached cover memo along with the settlement agreement, which are only being distributed to <br />the Council at this time. The purpose of this exercise is to provide an opportunity to 1) review <br />the document before it is made public and 2) ask questions at the work session (i.e. in a closed <br />executive session), if so desired. <br />If the Council finds the settlement agreement acceptable, the terms and conditions of the final <br />settlement will be made public upon formal Council action. At this point, we have placed this <br />item on the consent agenda, unless there is a desire to remove it for discussion purposes. <br />Jack Harper will be available at the work session and regular meeting on May 13`" to answer <br />questions, if necessary. <br />Costs and Funding: The final settlement will be paid for out of the Municipal Development <br />Fund (460). <br />—4t -- <br />Gran elius <br />Community Development Director <br />
