Approved <br />. Al Witte, Miller Architects and Builders, stated that the owner would like to keep the accessory <br />building and suggested that the curb line be kept at six -feet up to the shed and continue it after <br />the shed, instead of having it go around it. They also proposed that the door would be moved. <br />He also provided a sample panel of the proposed exterior. Commissioner Danger asked how old <br />the shed is and what the condition of it is. Witte replied it is old, with aerial photographs from <br />the 1950's showing the shed. The property owner has refurbished the building. He added that <br />the owners would house the equipment for yard maintenance and snow removal. <br />Dave Cannif, Inter -Plant Sales, stated that the shed does have sentimental value, since his Dad <br />started the business. They would move the garage door and plant trees so it is not visible from <br />the road. If it must be destroyed then they would like to at least be able to utilize it for storage <br />purposes during the construction of the new building. <br />Art Berg, property owner of the apartment complex just to the south, voiced concerns that there <br />would be large semi trucks, which would be loud and the street may be compromised. <br />Resident who lives on New Brighton Road stated that he is concerned about the increase of truck <br />traffic in a residential area. Cannif replied that there would be one to two trucks a day using <br />Cleveland Avenue, not New Brighton Road, as the access point into the general area. <br />Motion by Zisla, second by Schiferl to CLOSE THE PUBLIC HEARING. <br />0 7 ayes, 0 nays. MOTION APPROVED. <br />Schiferl asked if by adding the trees to reduce the impact of the shed from the street if that would <br />reduce the nonconformity. Zisla replied that it would not reduce it, since the issue is the setback. <br />Motion by O'Keefe, second by Danger to recommend approval of the Site Plan, Variance, and <br />Vacation subject to the following conditions: <br />1. Withdrawal of the Nonconforming Use Permit request and submission of a revised Site <br />Plan eliminating the existing 24' x 28' garage structure at the northeast corner of the site. <br />The applicant shall establish a curb at a setback consistent with the proposed curb -lines to <br />the east and west. However, the applicant may utilize the shed during construction with <br />submission of a Letter of Credit as collateral to ensure demolition. <br />2. Implementation of the recommendations of the Director of Public Works/City Engineer <br />noted in the Interoffice Memo dated 5/15/2008, made a part of this report. <br />3. The applicant agrees to re -address the site to 50 New Brighton Road, consistent with the <br />City of New Brighton's address scheme on New Brighton Road. <br />4. Implementation of any forthcoming comments of the City Forester on the Landscape <br />Plan. <br />5. The applicant shall demonstrate compliance with Section 6-390 (12) with regard to <br />exterior building materials on the street sides of the structure. <br />6. Removal of the southem-most parking stall on the west end of the proposed building. <br />The front yard shall be extended north into this area to better complying with yard <br />requirements. <br />7. All proposed signage shall comply with Zoning Code Section 9-100. <br />S. Prior to issuance of a building permit, the applicant shall provide a permit from the Rice <br />Creek Watershed District. <br />
