Motion Approved. <br />Public Hearings: LP2008-005, SP2008-008 Site Plan and Special Use Permit to allow <br />construction of an outdoor dining patio at the north end of the existing Champp's restaurant. <br />The applicant is requesting re -approval of a Site Plan and Special Use Permit for property <br />located at 2397 Palmer Drive, known as the Champp's restaurant. These approvals would allow <br />for construction of a patio approximately 30' x 60' in size at the north end of the existing <br />building. An exterior improvement to a commercial or industrial property requires a Site Plan <br />and outdoor dining is a Specially Permitted Use is the B-3, General Business District. <br />The applicant obtained Site Plan and Special Use Permit approval for this project on April 24, <br />2007. However, for a number of reasons the applicant was not able to construct the patio and <br />allowed the Site Plan and Special Use Permit to expire. The applicant has now indicated a desire <br />to begin construction early this summer. <br />The proposed project is identical to the 2007 approved project. As such, staff did not provide a <br />new written report, rather the 2007 report was provided to the Commission for reference. <br />Howard asked about the sidewalk on the south side of Palmer Drive and if there is a sidewalk <br />connection to Champp's at Champps' front door. Gundlach replied that the plans depict no <br />official connection. <br />Danger asked if the special use permit should cover any use regulations of the patio, such as <br />music. Gundlach replied that those issues were addressed in the 2007 application and would be <br />covered by the nuisance code. <br />The applicant replied that he does not believe that there is a reason to connect the entrance to the <br />south sidewalk, but would consider adding it. Zisla stated that there were some battles with <br />Kraus Anderson regarding the installation of the sidewalk and recommended that the applicant <br />tie the entrance of the building into the sidewalk Zisla asked if the sign will be repaired. The <br />applicant replied that it would be repaired. Schiferl asked if the applicant plans on hold any <br />outdoor concerts. The applicant replied that they would not hold any outdoor concerts as the <br />new parking situation does not allow for this type of event. <br />Motion by O'Brien, second by Baker to CLOSE THE PUBLIC HEARING. <br />7 ayes, 0 nays. MOTION APPROVED. <br />Motion by O'Brien, second by O'Keefe ADOPT THE ATTACHED RESOLUTION RECOMMENDING <br />THE CITY COUNCIL APPROVE THE SITE PLAN AND SPECIAL USE PERMIT IN ACCORDANCE <br />WITH RESOLUTION 07-031, WITH THE FOLLOWING CONDITION: <br />• 1.
