<br /> ~ .. <br /> " ~, t <br /> ~. <br /> "- <br /> 'iff' "- <br /> RESOLUTION NO. 2166 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR NON-CONFORMING USE PERMIT NC-35, PEDERSON. <br /> WHEREAS an application for a non-conforming use permit <br /> entitled.NC-35,ameriding NC-19, has been made by Gale <br /> Pederson to permit parking on landscaped areas of the <br /> building located at 550 1st Street S.W. <br /> WHEREAS the procedural history of the application is as <br /> follows: <br /> l. That an application for NC-19, Pederson was <br /> approved by the City Council by Resolution <br /> 1894 on June 14, 1977. <br /> 2. That an application NC-35 to amend NC-19 was filed <br /> with the City on December 6, 1978. <br /> 3. That such application was reviewed by the New <br /> Brighton Planning Commission Board of Review on <br /> December 19, 1978. <br /> 4. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on <br /> January 23, 1979 and continued such hearing <br /> to February 23, 1979 and all person's present <br /> at the hearing were given an opportunity to be <br /> heard. <br /> 5. The written comments -'andanalysis of the City <br /> Planner, the Planning Commission minutes and <br /> recommendations were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton <br /> City Council makes the following Findings of Fact in <br /> Respect to NC-35: <br /> l. The existing and proposed use of the property is <br /> a truck garage and repair shop. <br /> 2. The followi ng Type IV non-conformities were <br /> identified on the property in the application <br /> NC-19: <br /> a. Lack of concrete, curbing in front yard, <br /> b. Front yard parking, <br /> c. Less than required front yard landscaping, <br /> d. Lack of a dustless driving surface, <br /> e. Inadequate wall treatment facing a public <br /> street. <br />
