"'_ tJt t. -e -y , 1966 by and between the Village of New Brighton and the Village of St. Anthony both being Municipal Corpor- ations under laws of the State of Minnesota. WHEREAS County Ditch #3 drains surface water from the cities of Minneapolis and Columbia Heights and the Villages of St. Anthony and New Brighton and lands and road of Ramsey County into County Ditch #2 and thus into Long Lake, and WHEREAS the Parties to this agreement have determined that the improvement of Ditch #3 as hereinafter defined i. in the best interests of the two Villages, and WHEREAS the improvement of Ditch #3 as hereinafter defined will result in a change of the pattern of flow into Ditch #2 and that Ditch #2 also requires improvement, and WHEREAS the County Commissioners of Ramsey County have pending before it the joint petition of the Villages of Roseville and New Brighton for the improvement of County Ditches 2, 3, and 5, and WHEREAS it is the desire of the parties hereto to improve Ditch #3 as hereinaft.er I defined as a joint venture between the two villages, and WHEREAS, Orchard Place, also known as Silver Lane, is a street running east and west, the center of which is the boundary between the Villages of St. Anthony and New Brighton and it is the desire of these two villages to improve this street on a joint basis and the improvement of such street can only be undertaken following the improvement of County Ditch #3. NOW THEREFORE, IT IS AGREED by and between the parties as follows: 1. That Orchard Place, also known as Silver Lane, shall be improved in accord- ance with the plans and specifications therefore to be prepared by Comstock and Davis, Consulting Engineers for the Village of St. Anthony and to be approved by New Bri ghton. That the cost of such improvement shall be divided equally between the two villages. The contract for such construction shall be let by the Village of St. Anthony in accordance with State Statutes and the construction shall be super- vised and inspected by the firm of Comstock and Davis. 2. The Village of St. Anthony shall give 60 days notice to New Brighton of the amount to be paid so as to provide New Brighton adequate opportunity to secure the project funds due from New Brighton. 3. All disbursements by the ~11age of St. Anthony shall be in accord with the requirements of applicable state law. 4. Contracts let and purchases made under the agreement shall confonm to all legal requiMements applicable to contracts and purchases by the Village of St. Anthony. Copies of all contracts shall be furnished to New Brighton for examin- ation and approval prior to execution of the contract. Approval by New Brighton shall be in writing by resolution.
