"'_ tJt t. -e -y , 1966 by and between the <br /> Village of New Brighton and the Village of St. Anthony both being Municipal Corpor- <br /> ations under laws of the State of Minnesota. <br /> WHEREAS County Ditch #3 drains surface water from the cities of Minneapolis and <br /> Columbia Heights and the Villages of St. Anthony and New Brighton and lands and road <br /> of Ramsey County into County Ditch #2 and thus into Long Lake, and <br /> WHEREAS the Parties to this agreement have determined that the improvement of Ditch <br /> #3 as hereinafter defined i. in the best interests of the two Villages, and <br /> WHEREAS the improvement of Ditch #3 as hereinafter defined will result in a change <br /> of the pattern of flow into Ditch #2 and that Ditch #2 also requires improvement, <br /> and <br /> WHEREAS the County Commissioners of Ramsey County have pending before it the joint <br /> petition of the Villages of Roseville and New Brighton for the improvement of County <br /> Ditches 2, 3, and 5, and <br /> WHEREAS it is the desire of the parties hereto to improve Ditch #3 as hereinaft.er I <br /> defined as a joint venture between the two villages, and <br /> WHEREAS, Orchard Place, also known as Silver Lane, is a street running east and <br /> west, the center of which is the boundary between the Villages of St. Anthony and <br /> New Brighton and it is the desire of these two villages to improve this street on a <br /> joint basis and the improvement of such street can only be undertaken following the <br /> improvement of County Ditch #3. <br /> NOW THEREFORE, IT IS AGREED by and between the parties as follows: <br /> 1. That Orchard Place, also known as Silver Lane, shall be improved in accord- <br /> ance with the plans and specifications therefore to be prepared by Comstock and <br /> Davis, Consulting Engineers for the Village of St. Anthony and to be approved by <br /> New Bri ghton. That the cost of such improvement shall be divided equally between <br /> the two villages. The contract for such construction shall be let by the Village <br /> of St. Anthony in accordance with State Statutes and the construction shall be super- <br /> vised and inspected by the firm of Comstock and Davis. <br /> 2. The Village of St. Anthony shall give 60 days notice to New Brighton of the <br /> amount to be paid so as to provide New Brighton adequate opportunity to secure the <br /> project funds due from New Brighton. <br /> 3. All disbursements by the ~11age of St. Anthony shall be in accord with the <br /> requirements of applicable state law. <br /> 4. Contracts let and purchases made under the agreement shall confonm to all <br /> legal requiMements applicable to contracts and purchases by the Village of <br /> St. Anthony. Copies of all contracts shall be furnished to New Brighton for examin- <br /> ation and approval prior to execution of the contract. Approval by New Brighton <br /> shall be in writing by resolution. <br />
