<br />~. , <br />" <br /> , , <br /> St. Anthony shall maintain records indicating all expenditures, dates , , <br />5. <br /> thereof, and reasons therefore. <br />6. All routine maintenance to the street shall be performed by the respective <br /> municipality wherein the street lies. <br />7. Ditch #3 for the purposes of this agreement is deff.ed as and includes the <br /> following: <br /> Ditch #3 as officially designated by Ramsey County records (which <br /> runs generally in an easterly direction from the outlet of Silver <br /> Lake to the pond in Sault Ste. Marie Park): Branch #1 of Ditch #2 <br /> according to the Ramsey County records (which runs generally in an <br /> easterly direction from the pond in Sault Ste. Marie Park to Jones <br /> Lake) and the bypass partially constructed by the Village of New <br /> Brighton along the northwesterly side of the Soo Line Railroad <br /> tracks from an outlet on the northwesterly shore of Poplar Lake <br /> to ditch #2 near the intersection of Old State Trunk Highway #8 <br /> and the Soo Line Railroad tracks. <br />8. That Ditch #3 as above defined shall be improved in accordance with the . <br /> final plans and specifications prepared by Milner W. Carley and Associates, and <br /> approved by the St. Anthony Village Engineer and the Ramsey County Board of Commiss- <br /> ioners. A copy of the plans are attached and made a part of this contract by refer- <br /> ence. The contract shall be let and work on the improvement shall be started on or <br /> before July 1, 1967 unless a circumstance arises which delays the work which circum- <br /> stance is not in the control of either party. <br />9. That the total costs of so improving Ditch #3, as defined, shall be borne <br /> by the Cities of Minneapolis and Columbia Heights, the Villages of St. Anthony and <br /> New Brighton, and the County of Ramsey according to the following percentage <br /> divisions: <br /> Total System <br /> Percentages <br /> New Bri ghton 57.7 <br /> St. Anthony 38.6 <br /> Columbia Heights 2.9 <br /> Minneapolis 0.2 <br /> Ramsey County 0.6 <br />10. The proportionate share of the cost of improving Ditch #3 as defined by Ram- <br /> sey County and the Cities of Minneapolis and Columbia Heights shall be sought from <br /> these cities and county and the parties hereto agree to take all necessary steps to <br /> enforce such contributions. If the contribution of the County of R~sey and the <br /> Cities of Minneapolis and Columbia Heights is not obtained by the time final payment <br /> on the improvement contract is due and payable, the parties to this agreement hereby <br /> agree to advance the shares of Ramsey County and the Cities of Minneapolis, and <br /> Columbia Heights in the same propa- Hon as they shall be obligated for their own <br /> share of the costs and if subsequent thereto recovery shall be made in whole or in <br /> part, such recovery shall be reimbursed to the parties hereto in the same proportion <br /> as the advances. <br />1 I. St. Anthony hereby agrees to encourage the Ramsey County Board of Commiss- <br /> ioners to order the improvement of County Ditch 2 as petitioned for by New Brighton <br /> and Roseville, provided that if the improvement of County Ditch 2 is ordered, <br /> St. Anthony shall only be obligated to pay its proportionate share of such improve- <br /> ment based upon the downstream capacity needed to handle flows from St. Anthony. <br />
