The elevation of the outlet from Silver Lake shall be set at the present elevation of the 24 inch culvert under Silver Lake Road subject to the provision that the outlet elevation of the present 24 inch culvert under Silver Lake Road may be set at a lowered elevation as determined and set by the Ramsey County Board of Commissioners. If the outlet elevation of lake is lowered by the Ramsey Cty..~d. the discharge. capacity from Silver Lake Which is the beginning of County Ditch 3 shall not be increased beyond an 18 inch culvert capacity until such time as County Ditch 2 is improved. . The intention of the parties in requesting a lowered elevation in the outlet of Silver Lake is to increase the water storage capacity of Silver lake. 13. That the parties hereto will by proper motion in their presently pending lawsuit obtain the approval of the Board of County Commissioners of Ramsey County for permission to jointly improve ditch #3 in accordance with the plans and specif- ications prepared by Milner W. Carley and Associates. 14. The Village of New Brighton shall give 60 days notice to St. Anthony of the amount to be paid so as to provide St. Anthony adequate opportunity to secure the project funds due from St. Anthony. 15. All disbursements by the Village of New Brighton shall be in accord with the requirements of applicable state law. 16. Contracts let and purchases made under the agreement shall conform to the legal requirements applicable to contracts and purchases by the Village of New Brighton. Copies of all contracts shall be furnished to St. Anthonv for examination and approval prior to execution of the contract. Approve 1 by the Vi 11age of St. Anthony shalt be in writing by resolution. 17. New Brighton shall maintain records indicating all expenditures, dates thereof, and reasons therefore. It is also agreed that neither party to this agreement shall drain any additional area into the storm sewer system as constructed by New Brighton without first obtaining the permission to do so from the other parties. 18. All routine maintenance to the storm sewer line shall be performed by the respective munid pa lity wherein the storm sewer 1ie~. . Maintenance sha 11 include., removai'of debris from tbe .anboles and catch basins and the ins~ction of lateral lines. 19. The parties hereto agree that the purpose of this agreement is to make the described improvements as soon as practicable and both villages agree hereby to promptly do all things necessary and incidental to the performance of this agree- ment and they further hereby agree that in the event agreement as to the financial obligations of the parties hereto cannot be mutually agreed upon that the respect- ive financial obligation of the parties hereto be determined by a mediator appoint- ed by the two villages. In the event the parties are unable to agree upon the mediator, such determination shall be made on the petition of either party to the District Court of Ramsey County and decision of the mediator shall be final and binding on the parties hereto with no right of appeal.
