" " <br /> ~;. , , . <br /> L <br /> STATE OF MINNESOTA COUNTY OF RAMSEY <br /> Before the Metropolitan Sewer Board, <br /> an Agency of the Metropolitan Council <br /> -------------------------------------------------------------------------------- <br /> NOTICE OF OBJECTIONS TO AND APPEAL FROM 1971 <br /> and 1972 BILLINGS TO THE VILLAGE OF NEW BRIGHTON <br /> r <br /> PLEASE TAKE NOTICE that the Village of New Brighton does hereby object to <br /> and appeal from the billings of charges and credits from the Metropolitan Sewer Board <br /> for the years 1971 and 1972. The objections and grounds fro appeal are as follows: <br /> 1. The determination of the payments and credits for the acquisition of the facilities <br /> of the North Suburban Sanitary Sewer District is not equitable and is not adequate in dollar <br /> amount which results in Current Value Credit and Debt Payment Credit to the Village of <br /> New Brighton being less than a fair and equitable sum. <br /> 2. That the Village of New Brighton is the owner and operator of an interceptor <br /> sewer which is designed and used to conduct sewage originating in more than one local <br /> government unit and which is designed and used to conduct all or substantially all of the <br /> sewage originating in a single local government unit from a point of collection in that unit <br /> to an interceptor and treatment works outside that unit. That the Metropolitan Sewer <br /> Board failed and refused to acquire such interceptor from the Village of New Brighton, <br /> and that such failure and refusal results in a Current Value Credit and Debt Payment Credit <br /> to the Village of New Brighton in a sum substantially less than that required by law and equity. <br /> 3. That within Sewer Service Area No. 02, which is the Sewer Service Area that <br /> the Village of New Brighton is within, the assignment of Reserve Capacity is done in <br /> such a manner that some local units of government for which there is an actual reservation <br /> of capacity are not being charged for such reserve capacity and this results in an excessive <br /> charge for reserve capacity to the Village of New Brighton. <br />
