That the 1971 Billing to the Village of New Brighton was presented as an estimated <br /> billing, which would be adjusted after December 31, 1971, based on actual experience <br /> during the calendar year 1971. That the Village of New Brighton has no assurances or <br /> guarantees that such an adjustment will be made and no procedure for a challenge if the <br /> adjustment is not made or if made and found to be inequitable. <br /> 6. The formula for repayment to the Village of New Brighton of Current Year <br /> Deferment Charges is not fixed so as to adequately guarantee repayment at a fixed time <br /> with a fixed interest rate. <br /> 7. That the complete purchase of the Brooklyn Park Interceptor by the Metropolitan <br /> Sewer Board results in a charge to New Brighton for sewer lines which in no way benefits <br /> New Brighton. <br /> 8. That the announced policy of charging in the future to the Village of New Brighton <br /> the costs of constructing interceptor sewer lines into Maple Grove and Lino Lakes areas <br /> is a plan to charge New Brighton for sewer lines which will never benefit New Brighton. <br /> 9. That in 1971 the billing to New Brighton included charges for facilities which the <br /> Metropolitan Sewer Board intended to acquire but in fact never did acquire. <br /> 10. That the Metropolitan Sewer Board purchased an interceptor sewer line from Osseo <br /> which will be abandoned resulting in some charges to New Brighton for the purchase of the <br /> line to be abandoned and for the new line being constructed to replace it. <br /> 11. That the computation and method of computation of charges and credits by the <br /> Metropolitan Sewer Board to the Village of New Brighton for the years 1971 and 1972 <br /> are arbitrary, capricious, inequitable and unlawful. <br />
