' <br /> --- -~...- ....- ..-.......-- <br /> .-.-,.- ----- <br /> --- -~-- "" . <br /> ."... <br />, <br />,. .. <br />of <br /> RESOLUTION NO. 1651 A <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT, DENYING PRELIMINARY PLAT PL-lOO <br /> AND STATING REASONS FOR SUCH DENIAL <br /> WHEREAS an application has been made to plat certain lands in <br /> the City of New Brighton known as PL-lOO, Oakwood Estates, and <br /> WHEREAS such application has been processed, reviewed by the Planning <br /> Commission, reviewed by the Building and Planning Coordinator and <br /> considered by the City Council at a Public Hearing <br /> NOW THEREFORE BE IT RESOLVED by the New Brighton City Council <br /> that it makes the following findings of fact. <br /> Findings of Fact <br /> 1- That an application for approval of a preliminary plat known <br /> as Oakwood Estates was made on September 3, 1975 and the <br /> fee paid. <br /> 2. That the application was assigned the designation PL-lOO <br /> and referred to the Planning Commission for its review and <br /> recommendation. <br /> 3. That the Planning Commission did on September 16, 1975, <br /> consider the application, and did recommend denial of PL-lOO <br /> for 5 stated reasons. <br /> 4. That a public hearing was duly scheduled for October 28, <br /> 1975, before the City Council and published and mailed notices <br /> of such hearing were duly made according to law. <br /> 5. That a public hearing was duly held on October 28, 1975, <br /> by the City Council at which time the applicant and all other <br /> persons present were given an opportunity to be heard. <br /> 6. That the City Council did consider the application, the <br /> statements made by the applicant and other persons at the <br /> public hearing, the report of the Building and Planning <br /> Coordinator, the recommendation of the Planning Commission <br /> and the character of the land and its surroundings. <br /> 7. That the City Council did, on November 12, 1975, request of <br /> the applicant the following additional information: <br /> a. Soil borings by a professional including the professional's <br /> findings and evaluations. <br /> b. A written description of the proposed use and development <br /> of Lot 3, Block 1 and Lot 3, Block 2. <br /> c. Sketches which demonstrate the ability to subdivide <br /> Lot 3, Block 1 and Lot 3, Block 2, in conformity with the <br /> New Brighton platting code. <br />
