The architectua1 design of the complex is such that any <br /> substantial wall signing would defeat the design characteristics <br /> of the complex and be in conflict with the purpose and intent of <br /> the Code. <br /> 8. Because of the physical location and orientation of this <br /> large apartment complex, it is necessary that a legible <br /> sign confronting the freeway be permitted. <br /> 9. Except for the design characteristics of the complex, the <br /> building sizes would permit wall signs much larger than the <br /> sign being applied for. <br /> 10. This particular application for variance meets all of the <br /> criteria for the granting of a variance under the Code due <br /> to the unique location and orientation of the complex. <br /> BE IT FURTHER RESOLVED That Variance VN-l39 be granted on the <br /> following conditions: <br /> 1. That all other signing on the property be made to conform to <br /> City Code forthwith. <br /> 2. The sign facing 1-694 not exceed l28 square feet in size and <br /> the copy be in conformity with a copy design drawing signed <br /> and dated by the applicant as of August 1975. <br /> BE IT FURTHER RESOLVED, That the reasons for the grant;i..ng of <br /> this variance are as follows: <br /> 1. Practical difficulties, exist due to the fact that this <br /> apartment complex is oriented with frontage on the freeway <br /> and wall signs would be impractical due to the design. <br /> 2. Unnecessary hardship, exists because there are no principal or <br /> accessory structures in the complex upon which a legally <br /> permissible wall sign of a size and location to be effectively <br /> visab1e from the freeway, could"be erected. <br /> 3. To permit the requested sign does not permit results incon- <br /> sistant with the qenera1 purpose of Chapter ~IV of the <br /> Zoninq Code in that, except for the unique arch'\itectual <br /> design of this complex, wall signs much larger khan the one <br /> being permitted, could have been erected. <br /> 4. Special Circumstances, exist in this particular instance due <br /> to the physical location and orientation of the apartment <br /> complex. <br /> 5. The granting of this variance does not constitute a special <br /> privi1eqe because this apartment complex is unique in that <br /> its physical setting of fronting on the freeway. <br />
