CITY OF NEW BRIGHTON, MINNESOTA AND MINNESOTA FEDERAL SAVINGS AND LO~ ASSOCIATION THIS AGREEMENT made this 11th day of March, 1975 by and between the City of New Brighton, Minnesota, hereinafter called New Brighton, and Minnesota Federal Savings and Loan Association, hereinafter called Minnesota Federal, witnesseth: WHEREAS Minnesota Federal desires to construct and operate a branch office at the northwest corner of Silver Lake Road and Palmer Drive, and WHEREAS access to the parcel is not feasible from Silver Lake Road, and Palmer Drive west of Silver Lake Road will not be completed until 1976, and WHEREAS Minnesota Federal desires to partially and temporarily improve part of the right-of-way of Palmer Drive west of Silver Lake Road to provide access to its building until Palmer Drive is completed by New Brighton, and WHEREAS New Brighton is willing to grant to Minnesota Federal permission to use the Palmer Drive right-of-way for such purpose on certain terms and conditions NOW THEREFORE it is hereby agreed by and between the parties hereto as follows: I. New Brighton does hereby grant to Minnesota Federal temporary permission to improve that portion of the Palmer Drive right of way lying west of Silver Lake Road as more fully set forth on the plans and specifications attached hereto and made a part hereof as Exhibit A, which plans and specifications have been approved by the New Brighton City Engineer. 2. ~lat the improvement by Minnesota Federal of a portion of the Palmer Drive right of way shall not commence until Ne\\1 Brighton has completed the installation of all necessary under- ground utilities. 3. That Minnesota Federal shall not be granted a certifi- cate of occupancy for its branch office building until the tempor- ary improvement of the Palmer Drive right of way described in Exhibit A is completed and west facing semaphores at the inter- section of Palmer Drive and Silver Lake Road are installed and operating. 4. Minnesota Federal shall pay the cost of any temporary west facing semaphores at Palmer Drive and Silver Lake Road. S. Minnesota Federal shall be responsible for all mainten- ance on the temporary improvement described in Exhibit A, including snow removal.
