That Minnesota Federal, by these presents, and in <br />consideration of the agreements of New Brighton herein contained, <br />does hereby covenant and agree that it will make no claim against <br />New Brighton for any of the costs incurred by Minnesota Federal <br />in construction, maintaining and using the Palmer Drive right-of- <br />way or for damage to or loss of such improvement, signs and <br />appurtenances when New Brighton constructs a permanent surface on <br />Palmer Drive, and further that Minnesota Federal shall hold New <br />Brighton harmless from claims of any nature and description by any <br />person, firm or corporation for any reason whatsoever arising out <br />of or from the construction, maintenance, use, or removal of such <br />temporary use for access of the Palmer Drive right of way by <br />Minnesota Federal, its agents, employees, customers or the general <br />public. <br /> <br /> <br />ATTEST: CITY OF Nf..'W BRIGHTON <br /> <br />" <br />tf.. .
