<br />~ <br /> ,. ~ <br />~ <br />r <br />. , 1479 <br /> RESOLUTION NO. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT FOR VARIANCE APPLICATION <br /> VN-137 BEING A VARIANCE FROM PARKING AND SETBACK REGULATIONS, <br /> AND DENYING SUCH APPLICATION <br /> WHEREAS Minnesota Federal Savings and Loan did on October 2!;, <br /> 1974, file its application for a variance from the setback and <br /> parking requirements of the New Brighton Zoning Code, and <br /> WHEREAS such application was processed by the City of New <br /> Brighton and considered by its City Council at a Public Hearing <br /> on December 10, 1974, and December 23, 1974. <br /> NOW THEREFORE BE IT RESOLVED, by the New Brighton City <br /> Council that it finds the following to be facts: <br /> 1. Procedural History <br /> a. That on October 25, 1974, Minnesota Federal <br /> Savings and Loan filed its application for a <br /> variance from the New Brighton Zoning Code <br /> applying to the property in the northwest corner <br /> of Silver Lake Road and Palmer Drive extended for <br /> the purpose of allowing construction of a savings <br /> and loan on such property with a 40' rather than <br /> the required 50' setback to the building from the <br /> north property line, for a IS' rather than the <br /> required 25' buffer strip to the parking lot <br /> from the north property line, for a IS' rather than <br /> the required 30' setback to the building from the <br /> south property line, for a 37~' rather than the <br /> required 50' setback of a driveway from the inter- <br /> section of Palmer Drive and Silver Lake Road,and <br /> for 36 parking stalls rather than the required 68 <br /> parking stalls. <br /> b. That such application, VN-137 , was duly referred to <br /> the Planning Commission and such Commission on <br /> November 19, 1974, did recommend denial of such <br /> application. <br /> c. That a public hearing on such application was duly <br /> scheduled before the City Council, and mailed and <br /> published notice of such hearing was properly made. <br /> d. That precedent to such hearing the applicant did <br /> amend the site and landscape plan in such a fashion <br /> as to require var iances only as to number of parkin~J <br /> stalls and building setback from the north property <br /> line. <br /> e. That pursuant to mailed and published notice, a <br /> public hearing was held by the New Brighton City <br /> Council on December 10, 1974, to consider <br /> application VN-137. <br />
