<br />. <br />~ ". . <br /> RESOLUTION NO. 1823 " .":'. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND DENYING APPLICATION FOR <br /> P RD NO. 21 AND THE RELATED FILL PERMIT <br /> WHEREAS an application forPRD No. 21 (Revision of PRD No. <br /> 18, PL-89, for lots 8 through 12, Block 1, Silver Oak Estates <br /> No. 3) has been made by the Daverne Corporation and an applicaticn <br /> for a permit to fill a body of water related to the development <br /> of PRD No. 21 has been made by the Daverne Corporation, and <br /> WHEREAS the procedural history of the application is as <br /> follows: <br /> 1. The application for PRD No. 21 was filed with the City <br /> on February 6, 1976, and the related fill permit <br /> application was filed with the City on April 7, 1976i <br /> 2. The City Council, pursuant to published and mailed <br /> notice, held a hearing on March 23, 1976 relative to <br /> PRD No. 21, and continued the hearing to April 13, 1976, <br /> at which time PRD No. 21 and the fill permit were <br /> considered and continued the hearing to September 15, <br /> 1976, at which time PRD NO. 21 and the fill permit were <br /> considered and continued the hearing to December 14, <br /> 1976, at which time PRD No. 21 and the fill permit were <br /> considered~ <br /> 3. The city Council adopted a moratorium on issuance of <br /> permits for the land described in the application for <br /> PRD No. 21 on April 27, 1976, in order to study <br /> drainage problems in PRD No. 18i <br /> 4. The applicant and other persons present at the hearings <br /> were given an opportunity to be heard; <br /> 5. The written comments and analysis of the Building and <br /> Planning Department and the Planning Commission minutes <br /> and recqmmendations and all persons. statements made at <br /> the public hearing were considered at the public hearings <br /> including the statements of the applicant~ <br /> 6. The city Council rescinqed the moratorium on issuance <br /> of permits and declared a new moratorium on issuance of <br /> permits at their December 14, 1976 meeting. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> council makes the following Findings of Fact in respect to the <br /> application for PRD no. 21: <br /> Findinqs of Fact <br /> 1. That PRD No. 21 (Lots 8 through 12, Block 1, Silver <br /> Oak Estate No. 3) is a revision to PRD No. 18 as approved <br /> September 25, 1973 (otherwise known as PL-89) ~ <br /> 2. That because PRD No. 21 is a revision of PRO No. 18, <br /> the entirety of PRD No. 18 is subject to review by the <br /> City Councili <br />
