That the serving of liquor would lengthen hours of <br /> operation of the restaurant and this would have a <br /> deleterious effect on adjacent residences~ <br /> 6. That the type and character of traffic in the area would <br /> change due to the serving of liquor by creating more <br /> late evening traffic creating nuisances of noise and <br /> 1ights~ <br /> 7. That the city maintains and operates a park on the <br /> northeast corner of Silver Lake Road and Mississippi <br /> Street and Ironda1e High School is located northeast <br /> of the subject property~ <br /> 8. That children and students must pass by the subject <br /> property in a route to and from the park and high school' <br /> 9. That.becauE;e of t.he subject property's proximity to <br /> the park and school, the serving of liquor would have <br /> a detrimental effect on persons using the park and <br /> children attending the school: <br /> 10. That the proposed comprehensive plan being developed <br /> Joy the Planning Commission projects- the subject <br /> property's use as low density residential use~ <br /> 11. That a restaurant with a liquor license is a higher <br /> intensity commercial use than a restaurant without <br /> a liquor license thereby making the conflict with the <br /> proposed comprehensive plan more:substantia1; <br /> 12. That a license application similar in all respects to <br /> the subject application was denied by the Council on <br /> February 10, 1976~ <br /> 13. . That the Council ~uld be acting arbitrarily in issuing <br /> the subject license as there is no compeling reason in <br /> the interest of the public good to issue such on-sale <br /> intoxicating liquor license. <br /> BE IT FURTHER RESOLVED, That based on the above Findings <br /> of Fact the application by John J. Welsch Company for an on-sale <br /> intoxicating liquor license for 2550 Mississippi Street be and <br /> is hereby denied. <br /> Adopted this 14th day of December, 1976 <br /> ATTEST: <br /> ~w: ! e-P~~ <br /> Vernon C.
