<br /> >r . <br /> ""- fl " <br />, ;~ <br /> RESOLUTION NO. 1810 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A STREET WIDTH <br /> LESS THAN REQUIRED BY SECTION 1040:28 OF THE NEW BRIGHTON CODE OF <br /> ORDINANCES ~ <br /> WHEREAS at a special meeting on December 2, 1976, the City <br /> Council considered a request for a new road (Improvement 77-7) to <br /> be constructed at less than the width required in Section 1040:28 <br /> of the New Brighton Code of Ordinances, and <br /> WHEREAS the procedural history of the road improvement is <br /> as follows: <br /> l. A petition for street, water, and sewer improvements for <br /> Hipp's View point Addition was received by the Council on <br /> August 24, 1976~ <br /> 2. Resolution No. 1955 was adopted by the Council on August 24, <br /> 1976 initiating consideration of said improvement~ <br /> 3. Resolution No. 1975 adopted by the Council on November 9, <br /> 1976, received the Engineer's report on said improvement and <br /> ordered a hearing to consider said improvement~ <br /> 4. A. public improvement hearing was held on December 2, 1976, to <br /> consider said improvement~ <br /> 5. At such hearing a position memorandum was received from ten <br /> residents abutting elh 14th Avenue NW requesting that the <br /> Council construct .a road no wider than twenty-four feet on <br /> the Hipp's View Point Addition~ <br /> 6. At such hearings all persons, including the petitioner were <br /> given an opportunity to be heard and all testimony presented <br /> was duly considered by 'the Council. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> council makes the following findings of fact in respect to the <br /> request that a twenty-four foot wide road be permitted in the <br /> Hipp's ViewPoint Addition (Improvement 77-7) <br /> Findings of Fact <br /> j <br /> 1. That Section 1040:28, S ubd . 1 of the New Brighton Code of I <br /> Ordinances requires all streets to be constructed to a <br /> minimum width of thirty-two feet; <br /> 2. That Section 1040:34 of the New Brighton Code of Ordinance <br /> permits variation from the above provision when in the <br /> opinion of the Council such variation~does not affect the <br /> general sense of the above provision~ <br /> , <br /> ; <br />
