AN OFFENSIVE TRADES I <br /> LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION 1 <br /> WHEREAS the City of New Brighton is responsible for the <br /> general safety, health, welfare and well-being of its residents <br /> and has established codes to aid in carrying out this <br /> responsibility, and <br /> I <br /> I <br /> WHEREAS City Code Sections 265ert.titled Sewer Department I <br /> " <br /> Regulations and 860 entitled Offensive Trades, and Metropolitan <br /> Sewer Board Rules and Regulations for the Metropolitan <br /> Disposal System and the Minnesota Pollution Cont,rol Agency <br /> Standards all 'apply to the operation of The Menge1koch Co. as ~ <br /> a rendering business, and \ <br /> WHEREAS The City is aware and has been informed that certain <br /> deficiencies in the operation of The Menge1koch Co. have <br /> occurred in the past with respect to these codes, ru 1es, <br /> regulations and standards, and <br /> WHEREAS stack emission tests were performed on the emissions <br /> from stacks a., b. , and c., below by Pollution Control Systems- <br /> Horme1 Co. on August 18, 1976 and August 30, 1976 which tests <br /> indicated that emissions from stack a., barrel washing steam <br /> exhaust, were at an odor level of 250 odor units, substantially <br /> in excess of MPCA Regulation APC-9 and that emissions from <br /> stack b., packed tower scrubber 200-75-0-2, were at the limit <br /> of 150 odor units allowed by MPCA Regulation APC-9, and that <br /> said tests were found to be unsatisfactory by the Minnesota <br /> Pollution Control Agency (MPCA) because of deficiencies in the <br /> testing procedure and that such deficiencies would tend to <br /> produce test results indicating a greater degree of conformance <br /> to MPCA standards that was in fact the case, and <br /> I <br /> WHEREAS the deficiencies which previously existed in regard <br /> to disposal of sewage have, in the past, affected the safety, <br /> health, welfare and well-being of the City's residents in that <br /> such deficiencies cause plugging of the sanitary sewer and lift <br /> station, interference with sanitary sewer service to others, <br /> dumping of raw sewage on the open ground, and emission of <br /> offensive odors in the neighborhood, and <br /> WHEREAS the deficiencies in the odor emissions from The <br /> Mengelkoch Co. affect the safety, health, welfare and well-being <br /> of the residents of the City of New Brighton. <br /> NOW THEREFORE BE IT RESOLVED, That the Offensive Trades <br /> License of The Menge1koch Co. for the premises at 119 14th St. N~ <br /> be granted under the following conditions: <br />
