<br /> .. <br /> ~, . - , _,' 2 <br /> The petitioner, city of New Brighton, will pay all costs and expenses which <br /> may be incurred by the Rice Creek Watershed District by reason of this <br /> petition in the event the proceedings hereunder are dismissed or in the <br /> event that for any reason no contract for the construction of any improve- <br /> ment hereunder is let. <br /> The Investigation of Sediment Deposits in Long Lake report, dated March <br /> 1976, of the Rice Creek Watershed District is hereby incorporated in this <br /> petition by reference as evidence of the need of the improvements herein <br /> petitioned for, as a demonstration of the feasibility thereof, and of <br /> possible improvement design. <br /> The City of New Brighton should receive credit against any sums that <br /> pecome due from the City of New Brighton to the Watershed District for <br /> the money advanced by New Brighton for the Long Lake Sediment Study as <br /> such report represents much of the work that is required for a preliminary <br /> report from an engineer as required under Section 112.49 Minnesota <br /> Statutes. <br /> It is proposed that the improvements herein petitioned for be paid for by <br /> the Watershed District levying a special assessment against all benefited <br /> property as defined in Section 112.501 Minnesota Statutes. <br /> The City of New Brighton hereby recommends that the Watershed District <br /> utilize the services of the Ramsey County Soil and Water Conservation <br /> District in the design and making of the improvements petitioned for <br /> herein" <br /> The execution and submission of this Petition was authorized and directed <br /> by a resolution of the New Brighton Council, a certified copy thereof <br /> being attached hereto as Exhibit B. <br /> Date /O!/:J.!1t, CITY OF NEW BRIGHTON <br /> f .
